National Assembly Chairman: Executive thinking needs to shift from "management - control" to "creation - service"

Continuing the 45th Session, on the afternoon of May 14, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly on a number of special mechanisms and policies for private economic development.

According to the Government's Submission, the goal of developing the Resolution is to promptly institutionalize a number of the Party's policies and guidelines stated in Resolution No. 68-NQ/TU of the Politburo on private economic development, in order to improve the investment and business environment; create favorable conditions for the private economy to access resources; promote science, technology, innovation and digital transformation, green transformation, human resource training, expand the participation of private enterprises in important national projects, support pioneering enterprises, and reach international standards to create "pushes, levers, and fulcrums" to create new momentum, liberate resources, and productivity of the private economy.

The Government proposed a draft Resolution focusing on the following groups of tasks and solutions: Improving the business environment; supporting access to land resources, production and business premises; supporting finance, credit and public procurement; supporting science , technology, innovation, digital transformation and human resource training; supporting the formation of medium and large enterprises and pioneering enterprises.

Notably, the regulations on improving the business investment environment. The draft Resolution establishes the principles of inspection, examination, licensing and certification activities for enterprises, business households and individual businesses in the direction of: Not inspecting or examining each enterprise or business household more than once a year, except in cases where there is clear evidence of violations; strictly handling acts of abusing inspection and examination to harass and cause difficulties for enterprises; prioritizing remote inspection and examination based on electronic data, reducing direct inspection and examination; exempting on-site inspection for enterprises that comply well with legal regulations; shifting the management of business conditions from licensing and certification to publishing business conditions and post-inspection, except for a few fields that are required to carry out licensing procedures according to international regulations and practices.

Presenting the Verification Report, Chairman of the National Assembly's Economic and Financial Committee Phan Van Mai said that the Committee agreed with the necessity, political basis and practical basis for developing and promulgating the Resolution according to the simplified procedures and order; agreed with the scope of regulation and scope of institutionalization of Resolution No. 68-NQ/TU in the draft Resolution of the National Assembly as proposed by the Government.

The Committee recommends a thorough review of special mechanisms and policies applicable to private economic enterprises to ensure compatibility with relevant international treaties to which Vietnam is a member, avoiding violations of the principle of "national treatment" and commitments on public procurement.

Speaking at the meeting, National Assembly Chairman Tran Thanh Man stated: The drafting of the Resolution is very urgent. On May 4, 2025, the Politburo issued Resolution No. 68-NQ/TU; after 10 days (May 14, 2025), the National Assembly Standing Committee met to consider this issue before submitting it to the National Assembly.

The draft Resolution consists of 7 chapters and 17 articles. The National Assembly Chairman requested the agencies to review and develop a concise and clear draft Resolution, focusing on breakthrough and new contents in private economic development.

In drafting the Resolution, the National Assembly Chairman noted that the mindset must change: the State creates instead of controls; the management mindset needs to shift from "management - control" to "creation - service". The State does not stand outside the market, but also does not interfere too deeply in business operations. Legal guarantees and support for digital transformation and innovation are the ways the State accompanies the private sector on the development journey.

The National Assembly Chairman requested to ensure the constitutionality and consistency of the draft Resolution with the legal system, not only the laws that have been promulgated but also the laws that are being amended and supplemented to be submitted to the National Assembly at the ninth session such as: Criminal Procedure Code; Civil Procedure Code; Law on Administrative Procedure; Law on Handling of Administrative Violations; Inspection Law; Law on Corporate Income Tax; Law on Bidding; Investment Law; Law on Science, Technology and Innovation... These laws are also being considered for comprehensive amendments and supplements or some articles, therefore, it is necessary to specifically review to ensure consistency and consistency.

The National Assembly Chairman emphasized that ensuring financial resources to implement the Resolution is very important. Policies on: Infrastructure investment, land rental support for high-tech enterprises in the private economic sector, small and medium enterprises, innovative startups; financial and credit support for small and medium enterprises, startups, and innovative startups; reduction of budget revenue from policies on exemption and reduction of corporate income tax, personal income tax... all require huge financial resources to implement.

The National Assembly Chairman also proposed to carefully review the beneficiaries and conditions to ensure the feasibility and effectiveness of the policy in practice.
