Special prosecutor Jack Smith investigated and prosecuted Donald Trump in two federal criminal cases.
CNN and The New York Times on November 13, citing informed sources, revealed that special prosecutor Jack Smith intends to resign along with other members of the investigation team before US President-elect Donald Trump takes office in January 2025. Mr. Trump has declared that he will remove Mr. Smith "in 2 seconds" after taking office.

Mr. Smith, appointed by Attorney General Merrick Garland, is in charge of investigating and prosecuting Mr. Trump in the case of storing classified government documents in Florida after leaving office and the attempt to overturn the results of the 2020 presidential election in Washington, DC.
In July, the US Supreme Court ruled that the former president has immunity from prosecution for official actions while in office. Mr. Trump’s lawyers used that ruling to ask for the two cases mentioned above, as well as state cases in New York and Georgia, to be dismissed.
The Florida case was dismissed on the grounds that Smith was not constitutionally appointed, and the ruling is being appealed in federal court. After Trump was elected, the special prosecutor also asked the court to stay the case in Washington, DC, and most recently, the judge in the New York case postponed Trump's sentencing.
Under long-standing US Justice Department policy, a sitting president cannot be prosecuted criminally.
According to CNN, special prosecutor Jack Smith must submit his report to Attorney General Garland. The attorney general must approve and decide whether to make the report public. According to sources, Mr. Smith is trying to complete the report and resign first, instead of being fired by Mr. Trump.
