According to the representative of Champarama Resort & Spa Project, this is a project in which the state acquires land, so the specific compensation price will be determined by the state for each project according to the provisions of the 2013 Land Law.
The land status of people in Bai Tien area is mostly perennial land; agricultural land. However, the company has also issued a document announcing support policies for households that cooperate in handing over the land to share some of it with people at the project.
In addition to compensation support policies, encouraging people to hand over the site early, the company also has additional support policies for some families living in the project, which are poor households, those in especially difficult circumstances, families with revolutionary contributions, lonely elderly people, disabled people, cancer patients, etc. to promote the spirit of mutual love of the Vietnamese people. These supports are given by the company to the people through representatives of the People's Committee of Vinh Hoa Ward.
In addition, the company also has a policy of free vocational training for workers who are children of households within the project's scope of influence, and arranges suitable jobs when candidates complete the training course.
The project has many "bumps"
Champarama Resort & Spa was formerly known as Rusalka (Russian for Mermaid) and is invested by Rus-Invest-Tur Tourism Investment and Development Company (RIT) (chaired by Mr. Nguyen Duc Chi).
In 2005, while the project was under construction, Mr. Nguyen Duc Chi was arrested and sentenced to prison for “fraudulent appropriation of property”. Since then, the project has been abandoned.
When Mr. Chi was arrested, RIT Company's assets in Rusalka were also confiscated by the Ministry of Public Security . The Khanh Hoa Provincial People's Committee also revoked the land use right certificate of this project.
In 2010, the Supreme People's Court's Judicial Council decided to cancel the seizure of assets at Rusalka and return them to Mr. Nguyen Duc Chi when he was released from prison. Mr. Chi then established Focus Travel Nha Trang Joint Stock Company to continue implementing the Rusalka project.
In May 2013, Khanh Hoa Provincial People's Committee granted a new investment certificate to the Rusalka project under the name Champarama Resort & Spa. The new project was granted to Focus Travel Nha Trang Company, with Mr. Nguyen Duc Tan (Mr. Chi's younger brother) as director.
On December 12, 2015, Focus Travel Nha Trang Company was renamed Champarama Tourist Area Joint Stock Company with Mr. Chi as Chairman of the Board of Directors.
On January 6, 2016, Champarama Tourism Joint Stock Company was granted the first Investment Certificate change by the Department of Planning and Investment of Khanh Hoa province for the Champarama Resort & Spa project.
On June 3, 2019, the Business Registration Office - Department of Planning and Investment of Khanh Hoa province issued the 14th change of Investment Certificate No. 4201401023. At the same time, the investor of Champarama Resort & Spa project was changed from Champarama Tourism Joint Stock Company to Vega City Joint Stock Company.
On March 12, 2020, Khanh Hoa Provincial People's Committee issued investment policy decision No. 506 QD/UBND, approving the project investor as Vega City Joint Stock Company.
Legal representatives of Vega City Joint Stock Company include: Mr. Le Minh Tam, born in 1977, General Director; Mr. Kieu Huu Dung, born in 1967, Chairman of the Board of Directors.
The goal of the Champarama Resort & Spa project is to build a resort with main functions: resort, sports services, spa, restaurant, conference.
On October 27, 2016, Nha Trang City People's Committee issued Notice No. 826/TB-UBND to reclaim land to implement the Champarama Resort & Spa project, with a total reclaimed area of 288,030.4m2 (area B).
Disagreeing with Notice No. 826/TB-UBND, households have sent petitions to competent authorities to complain: Notice No. 82 on land recovery in Area B is illegal, no notice was sent to each person whose land was recovered, no reason for recovery was clearly stated, no plan for relocation and resettlement, no legal basis for land recovery in Area B - Bai Tien... The Ministry of Natural Resources and Environment and the Government Inspectorate have also sent documents to the People's Committee of Khanh Hoa province and the People's Committee of Nha Trang city requesting the settlement of citizens' petitions.
During the construction process, in October 2017, the authorities discovered that the project investor had encroached on Nha Trang Bay (a national scenic spot) with an area of more than 17,564 square meters and was fined 105 million VND and required the investor to take measures to restore the land to its original state before the violation.
