Dak Nong National Assembly Deputies give comments on draft Law on Science, Technology and Innovation

According to delegate Tran Thi Thu Hang, in Clause 19, Article 3 (Interpretation of terms), the draft Law stipulates: “A creative startup enterprise is an enterprise that conducts creative startup activities, has the ability to grow rapidly, has high risks and creates breakthrough economic or social values”. Therefore, the phrase “high risk” should be moved forward before the phrase “has the ability to grow rapidly…” to make the regulation more logical, because creative startup activities are doing something new, without practical verification, so first of all, there is “high risk”, but if successful, there will be “the ability to grow rapidly” and “create breakthrough economic or social values”. At the same time, the position of Clause 19 explaining the phrase “creative startup enterprise” should be moved right after Clause 13 defining “creative startup” to increase the logic in the overview of the law.

Delegate Tran Thi Thu Hang commented on the draft Law on Science, Technology and Innovation.

Regarding prohibited acts, Clause 3, Article 6 (Prohibited acts) of the draft Law states: “Conducting research, testing, and applying technology that causes serious damage to resources, the environment, biodiversity, and public health”. In order for the law to be highly feasible when put into practice, it is proposed to add: “Intentionally conducting research, testing, and applying technology that causes serious damage to resources, the environment, biodiversity, and public health”.

Clause 4, Article 22 (Protection of users of testing products and services) stipulates: “Announce the contact point for handling customer complaints. In case of disputes or complaints, the organization or enterprise licensed for testing is responsible for receiving and taking measures to handle all requests for verification and complaints in writing, via telephone switchboard, online platform or email of the user. The time for handling requests for verification and complaints shall be implemented according to the plan in the testing application file approved by the competent authority”.

Dai Hang believes that the method of receiving and handling complaints as prescribed in this article is to make complaints indirectly “in writing, via telephone switchboard, online platform or user email”. Therefore, it is necessary to add a direct form of complaint, because people can go to the headquarters of the organization or enterprise licensed for testing to make a direct verbal complaint to the department responsible for handling complaints and this case is recorded in the minutes of the meeting and can be recorded for comparison.
