The entity registering to use a domain name must be responsible for managing and using the registered domain name in accordance with the provisions of law on Internet resources.
This draft Circular guides the management and use of Internet resources, including: Registration, allocation, issuance, use, refund, suspension, revocation, transfer of usage rights, and dispute resolution, for agencies, organizations, and individuals participating in activities in the field of Internet in Vietnam.
Domain Name Registration
According to the draft, domain names are chosen by organizations and individuals for registration, but must meet the following requirements:
a- Vietnamese national domain name ".vn" is registered for use according to the structure prescribed in this Circular. International domain names are registered for use according to the structure prescribed by international domain name management organizations.
b- Domain names must not contain phrases that infringe upon national sovereignty , interests, and security; infringe upon the legitimate rights and interests of agencies, organizations, businesses, and individuals; violate social ethics, national traditions, and customs; and phrases related to illegal activities.
c- The registered subject uses the correct subject according to the instructions in this Circular. Subjects not eligible to register to use priority protected domain names shall not register to use domain names in the priority protected list.
d- Unrelated organizations and individuals shall not register to use domain names that are the names of Party organizations, state agencies, socio-political organizations (Vietnam Fatherland Front; Vietnam Trade Union; Vietnam Farmers' Association; Ho Chi Minh Communist Youth Union ; Vietnam Women's Union; Vietnam Veterans' Association...).
d- Unrelated organizations and individuals shall not register to use domain names related to activities to ensure the country's security, defense, and diplomacy .
e- Do not register to use domain names with confusing phrases such as general information websites or social networks if the registrant is not an entity granted a License to establish a general information website or a License to establish a social network according to the provisions of law.
g- Do not register to use a domain name that is similar or identical to the name of a press agency, and do not contain phrases that can be easily confused with a press agency or press product if the registrant is not a press agency.
Using domain name
The draft clearly states that using a domain name means that the entity that has been granted a domain name uses the domain name for services on the Internet, serving its activities, services, business or to protect its legitimate brand, products, and images.
The entity registering to use a domain name must be responsible for managing and using the registered domain name in accordance with the provisions of law on Internet resources.
The domain name ".vn" under ".edu.vn", ".gov.vn", ".org.vn", ".health.vn" must be used in the correct fields as prescribed in this Circular. In case the organization or individual that has been granted a domain name is no longer in the group of subjects eligible for registration as prescribed in this Circular, that organization or individual must carry out the procedure of returning the domain name if it does not transfer the right to use the domain name to another appropriate entity.
In case of registering a domain name to set up a general information website, social network, or electronic newspaper, if there is a change in the purpose of using the domain name, the subject must update information on the purpose of using the domain name or return the domain name in case the purpose of using it is no longer in accordance with the regulations.
Domain name registration procedure
When performing domain name registration procedures, the subject provides information according to the law on registration and use of Internet resources, expressed in the form of a Domain Name Registration Declaration according to the form published by the Registrar on the Registrar's website.
The information in the Domain Name Registration Form must be presented in a format that can be searched on the National Database system and the Specialized Database to compare information for domain name registration. The domain name registrant is responsible for the completeness and accuracy of the information and data provided.
In case it is not possible to compare and look up the information provided by the subject when registering the domain name in the Domain Name Registration Declaration, the Registrar receiving the registration request or the Vietnam Internet Center may request the registrant to provide information and documents proving that the domain name registration information is correct.
For domain names registered and used by individuals from 6 years old to under 18 years old, the domain name registrant must submit a Confirmation Letter from the parent or guardian regarding the registration and use of the domain name, along with the Domain Name Registration Declaration.
Applications for registration to use the ".vn" domain name are submitted to the ".vn" domain name registrars whose names are on the list published at: www.nhadangky.vn; applications for registration to use international domain names are submitted to the international domain name registrars in Vietnam published at: www.thongbaotenmien.vn.
Vietnam Internet Center publishes the list and contact addresses of Registrars at the above addresses.
Registration method
Encourage individuals, agencies, organizations and businesses to register domain names online through the system and tools for registration, authentication and management of online domain name records of Registrars announced by the Vietnam Internet Center at the address: nhadangky.vn for Registrars of Vietnamese national domain names ".vn" and the address: thongbaotenmien.vn for Registrars of international domain names in Vietnam.
In case it is not possible to register online, individuals, agencies, organizations and enterprises can register directly at the Registrar's facilities or send domain name registration information by post to the Registrar's facilities.
