According to the Decision, the economic and technical characteristics of drafting contracts and transactions are that notary offices create draft contracts and transactions on paper or in electronic data files to record agreements and terms between parties involved in the transaction, ensuring compliance with the law and not violating social ethics.
The process of reviewing and amending contracts and transactions involves a notary office examining a draft contract or transaction, whether in paper form or as an electronic file, prepared by the person requesting notarization; and amending the terms in the draft contract or transaction to ensure it complies with the law and does not violate social ethics, as requested by the person requesting notarization.
Contracts and transactions requiring notarization include: Business, commercial, and investment contracts; Contracts related to the exercise of land use rights as stipulated in the Land Law: Contracts for the transfer, donation, mortgage, and capital contribution using land use rights, land use rights and assets attached to the land; Contracts for leasing and subleasing land use rights, land use rights and assets attached to the land, contracts for converting agricultural land use rights; Contracts for the transfer and capital contribution using land use rights, land use rights and assets attached to the land, and assets attached to the land where one or more parties involved in the transaction are organizations engaged in real estate business; Documents concerning the inheritance of land use rights, land use rights and assets attached to the land; Contracts related to the exercise of rights of individuals and organizations over movable property; Power of attorney; Documents amending, supplementing, or canceling contracts and transactions; and other types of contracts and transactions.
The decision also stipulates the economic and technical characteristics of typing documents related to notarization, which is that notarization organizations input pre-existing documents, provided by the person requesting notarization, or transmit their intentions into electronic text or data format to create documents related to notarization as stipulated in Clause 3, Article 3 of this Decision.
The economic and technical characteristics of photocopying documents related to notarization involve notarizing documents using photocopiers/scanners from paper to paper or from paper to electronic data files, creating copies that are identical to the originals. Photocopying is calculated per page of the original document. The documents requested for photocopying must be those related to the notarization of contracts and transactions as specified in Clause 3, Article 3 of this Decision.
The economic and technical characteristics of document translation are that the translation collaborators of a notary office transmit information from Vietnamese to a foreign language or from a foreign language to Vietnamese without changing the meaning and content of the original document.
The Department of Justice shall preside over and coordinate with relevant agencies and units to guide, inspect, and supervise the implementation of the Decision. The Association of Notaries and notary practice organizations shall disseminate, thoroughly understand, and implement the contents of the Decision to their members, notaries, and staff.
