Proposing special authority for the Chairman of Hanoi People's Committee

The Ministry of Finance drafted a resolution of the National Assembly stipulating a number of specific mechanisms and policies to implement important projects to develop the capital, including proposing specific authority for the Chairman of Hanoi.

The Ministry of Justice is reviewing the draft resolution of the National Assembly stipulating a number of specific mechanisms and policies to implement important projects to develop the capital Hanoi. The draft was prepared by the Ministry of Finance.

Notably, the draft resolution stipulates a number of specific mechanisms and policies on the authority to decide and approve investment policies.

In particular, the City People's Council decides on investment policies for public investment projects and PPP projects of national importance or key projects of the capital, replacing the authority of the National Assembly according to general law.

The draft proposes that the Chairman of the City People's Committee is authorized to approve investment policies for investment projects according to the provisions of the Investment Law in cases that need to be implemented immediately under the direction of competent Party authorities, projects in the group attracting strategic investors, instead of the authority of the National Assembly, the Government, and the Prime Minister.

Except for some particularly sensitive areas (nuclear energy, telecommunications with network infrastructure, press - publishing, forestry, casinos, betting, games with prizes).

Along with that, the draft proposes that the City People's Council issue regulations on the order and procedures for establishing, appraising, deciding and adjusting investment policies applicable to the above projects, ensuring consistency and transparency in implementation.

In case the project needs to apply special mechanisms and policies different from current regulations, the draft stipulates that the City People's Committee must report to the City Party Executive Committee and the City People's Council for consideration and approval.

On that basis, report to the National Assembly Standing Committee for consideration and approval before the city agency decides.

This regulation creates a flexible mechanism, ensures legality, transparency, avoids arbitrariness, and at the same time strengthens the supervisory role of the City People's Council, the City Party Executive Committee and the National Assembly Standing Committee.

At the same time, protect public interests, facilitate timely implementation of important projects, unlock resources and remove legal obstacles, contributing to promoting the capital's socio-economic development.

The draft resolution also proposes a number of specific mechanisms and policies on selecting investors and contractors, policies on planning, architecture, land recovery, site clearance, land allocation, land lease, capital mobilization mechanisms for project implementation, and measures for urban renovation, refurbishment, and reconstruction.

Proposal that Hanoi be allowed to implement the emergency public investment mechanism and emergency construction order

Another content, the draft stipulates a number of specific mechanisms and policies related to measures to ensure urban order, social order and safety.

The Ministry of Finance stated that Hanoi is facing four prominent problems pointed out by General Secretary To Lam at the 18th City Party Congress, including traffic congestion, flooding, environmental pollution and urban order.

These are all urgent issues that directly affect people's lives, the image and competitiveness of the capital.

Through review, it is shown that current laws on public investment and construction only allow the implementation of emergency mechanisms for projects to prevent natural disasters, epidemics, national defense, security, and foreign affairs, but do not cover projects to handle the urgent urban issues mentioned above.

This leads to a long time for investment preparation, appraisal, and implementation, failing to meet the practical requirements of quick action to resolve the city's "bottlenecks".

In order to institutionalize the General Secretary's direction, create a specific legal mechanism for the City to quickly implement urgent projects on urban infrastructure and environment; minimize the time for investment preparation, appraisal, approval and construction organization of projects that need to be handled immediately.

At the same time, ensure urban order and social security, improve people's quality of life and enhance the city's capacity to respond to difficult urban problems.

Therefore, the draft stipulates that new investment projects or construction renovation projects to deal with traffic congestion, flooding, environmental pollution, and urban order are allowed to be implemented under the emergency public investment mechanism and emergency construction orders, according to the provisions of the law on public investment and construction.

Proposal to add cases of land recovery beyond the provisions of the Land Law

The draft also proposes to allow the Hanoi People's Committee to use the budget to establish independent compensation, support and resettlement projects before approving the investment policy, when there is a detailed plan and policy of the Standing Committee of the City Party Committee.

In addition to the cases of land recovery as prescribed in Article 79 of the Land Law, the draft proposes that Hanoi be allowed to recover land to implement socio-economic development projects for national and public interests, which must be implemented immediately under the direction of the Politburo, the Central Party Secretariat, the Government Party Committee, the Hanoi Party Executive Committee or the Standing Committee of the City Party Committee.

The Hanoi People's Council is allowed to use the budget to carry out compensation, support and resettlement when the State reclaims land with a minimum support level of 3 times but not more than 5 times the regulation to implement those projects.

For other projects, the City People's Council will decide on the level of compensation, support, and resettlement, but it must be higher than the prescribed level...
