Part 2. What solutions to speed up?
– After 2 years of restarting, the Hoang Dong Hotel and Golf Course Project has not achieved its planned goals, many items have not been implemented, and previously unfinished construction items have progressed slowly. Many difficulties and problems have arisen, requiring Lang Son province authorities and investors to focus on resolving them to speed up the project implementation progress.
Assessment of the Steering Committee for key projects of Lang Son province shows that by the end of the first quarter of 2023, the Hoang Dong Hotel and Golf Course Project is behind schedule, failing to meet the requirements of the province and investors.
Difficulties and obstacles in project implementation
According to our research, the process of the investor receiving the transfer and restarting the Hoang Dong Hotel and Golf Course Project has encountered many difficulties and problems, affecting the implementation of the project, leading to delays.

Among them, there are difficulties and problems in land acquisition and clearance such as: there are still some people who do not agree; the mechanism and policies for applying compensation and land acquisition and clearance have changed over many periods, so the authorities have to review the records and land acquisition plans; there is a lack of land to move graves out of the project implementation scope...
Specifically, in the project area, there are still 306 affected households that were previously entitled to land compensation support equal to 35% of the price of adjacent residential land but have not yet received it. From here, the City People's Committee must review and recalculate to approve additional support plans according to provincial regulations.
In addition, in the total area of more than 38 hectares being compensated for land, many households have not agreed, the city must complete the mandatory inventory process and implement the steps to enforce land recovery according to regulations. On the other hand, in the area being recovered, the city also has to carry out procedures to relocate about 200 graves of affected households from the project area. However, the lack of concentrated cemetery land fund to serve the relocation and verify the ownership of the graves is difficult, so the relocation progress is very slow. From 2022 to the end of April 2023, the City People's Committee coordinated with the investor to relocate only about 80 graves, the rest do not have a specific plan to relocate.
In addition, in Nam Thoong village, Hoang Tam hamlet, Hoang Dong commune, there is a separate cemetery of the village within the project recovery area. The households in the village requested to arrange a separate cemetery for the village to self-manage before handing over the land.
Mr. Hoang Van Thanh, Party Cell Secretary, Head of Hoang Tam Village, Hoang Dong Commune, said: The concentrated cemetery of Nam Thoong village was formed in 2005 and was subject to land acquisition. However, due to the long suspension of the project implementation, people still exploited that land to build the village cemetery. Currently, Nam Thoong village has about 50 households with graves in this cemetery. Through propaganda and mobilization, some households have agreed to relocate the graves, but about half of the households still do not agree.
In addition, the Nam Thoong village's Tho Cong temple has existed for a long time and is closely associated with the beliefs of the families in the village. The households do not agree to relocate the temple to implement the project. Currently, the investor is reviewing and reporting to the Provincial People's Committee to consider adjusting the Tho Cong temple out of the project scope.

On the investor side, although the People's Committee of Lang Son city has been determined in site clearance work in the past, the enterprise has not yet arranged sufficient and timely resources to speed up the project implementation progress. According to the data of the People's Committee of Lang Son city, by the end of April 2023, the city had established a compensation plan for site clearance with a total cost of about 60 billion VND, but the investor had only arranged about 30 billion VND for payment. The investor has not yet focused resources on constructing technical infrastructure items for areas with cleared land. In addition to the construction of some previously unfinished items, in this project, in the first months of 2023, there was no new construction volume.

It must be added that the Hoang Dong Hotel and Golf Course Project was taken over by the investor, so the completion and supplementation of legal procedures and documents still had many problems and took a lot of time. In addition, for the land area that had been handed over, there were still many locations that were not contiguous, causing many difficulties for the investor in land management and investment and construction planning. This was also part of the reason why the project implementation progress was slower than the progress registered by the investor and required by the Provincial People's Committee.
-The Hoang Dong - Lang Son Hotel and Golf Course Project is a case where the State reclaims land for socio -economic development, as stipulated in Articles 66, 67 and 69 of the 2013 Land Law. The compensation unit price is based on the specific land price issued by the Provincial People's Committee as stipulated in Clause 3, Article 114 and Point d, Clause 4, Article 114 of the 2013 Land Law. - In addition to the state's compensation and support mechanisms and policies, the project investor has reported on progress bonuses and other support for households and individuals who voluntarily declare, count and hand over the site, specifically: + For residential land: 1,000,000 VND/m2. + For agricultural land: 80,000 VND/m2. + For forest land: 30,000 VND/m2. + For graves: Households and individuals with graves declared and counted within the area of site clearance in phase 2 of the project (currently implementing site clearance) if they move graves out of the project implementation area before March 24, 2023 will be supported by the project investor with VND 5,000,000/grave (regardless of whether the grave is earthen or built). |
Urgently remove the "knot"
Clearly identifying the difficulties and obstacles in implementing the Hoang Dong Hotel and Golf Course Project, the provincial Party Committee and government determined that in order to speed up the implementation of this project, it is necessary to focus on removing "bottlenecks" regarding site clearance, project implementation resources, legal procedures, etc. Accordingly, one of the requirements set by the province is that the People's Committee of Lang Son city must complete site clearance and hand over the project site to the investor in June 2023. The Provincial People's Committee also requested the investor to allocate sufficient capital for site clearance according to the approved schedule; focus resources and mobilize capital to speed up the implementation progress as registered. At the same time, assign departments and branches to guide and support investors in carrying out legal procedures related to the project.
Implementing the direction of the province, with the goal of completing 100% of the project's site clearance work by the end of the second quarter of 2023, the People's Committee of Lang Son city has planned to step up propaganda and mobilize people affected by the project to agree and hand over the site; coordinate with the investor to organize the payment of site clearance compensation according to regulations.
Mr. Nguyen Van Hanh, Chairman of Lang Son City People's Committee, said: Regarding the difficulties in the project site clearance work, the city has strongly directed relevant departments and offices to resolve them within their authority. Regarding the issues beyond their authority, the city has reported to the Provincial People's Committee for consideration and direction to focus on immediate resolution.
Thanks to that, many problems have been and are being solved. Specifically, the proposal of Nam Thoong village on arranging a separate cemetery, expanding the area without reclaiming land close to residential areas, and not relocating the temple of the local god has been resolved by the city in coordination with the investor and departments and branches according to their authority. In particular, the cemetery planning of Hoang Dong commune has been determined by the city with an area of over 3 hectares; the city People's Committee and the investor are renovating the site and building roads to serve the relocation of graves.
Along with that, the city also stepped up propaganda and mobilized people to coordinate in measuring, counting, receiving compensation, support and handing over land to implement the project.
Mr. Tran Duc Tho, Director of the Lang Son City Land Fund Development Center, said: To speed up the compensation, support, and resettlement of the project, the center has advised the City People's Committee to develop a detailed plan to implement each task and report to the City People's Committee on the implementation status weekly. The center also established a working group of 6 officers to carry out the site clearance work and directly advise on removing difficulties and obstacles in the site clearance process. For affected cases that do not cooperate in receiving money and handing over the site, the center is coordinating with departments and offices to carry out the enforcement process in May 2023.
The specialized working group of the City Land Fund Development Center shared information with Lang Son Newspaper reporters about the project's site clearance situation.
Along with directing Lang Son city to speed up site clearance, the Provincial People's Committee also requested investors to focus on constructing resettlement areas and locations where the land has been handed over, and at the same time deploy the golf course project to promote other project items.
Regarding this issue, Mr. Vu Nhat, General Director of Lang Son International Joint Stock Company - the enterprise implementing the project, said: The construction of the resettlement area is behind schedule because the company has to re-implement the bidding process for the construction of technical infrastructure items according to the provisions of law. Up to now, the company has basically completed the procedures according to regulations to deploy the construction of the resettlement area in May 2023. Regarding the golf course item, the company has urged the consulting units to complete the design, and at the same time urgently carry out the step of selecting the construction contractor, as soon as the site is clean, construction will be started.
A building in the project is in the completion stage.
Faced with the fact that the project is behind schedule compared to the 7th investment certificate granted (2021), in order for the project to continue to be implemented in accordance with the provisions of law, the investor is carrying out the procedures for adjusting the project implementation time to submit to the competent authorities of the province for consideration and approval. Mr. Ha Manh Cuong, Deputy Director of the Department of Planning and Investment, said: The Department has received the dossier and is coordinating with departments, branches as well as the investor to review the entire project before implementing the step of approving the project adjustment according to regulations. The general spirit is that the Department joins hands to support the investor to the maximum so that the project is implemented in accordance with the provisions of law as well as contributing to promoting the project's progress.
The Hoang Dong - Lang Son golf course and hotel project is a project that is assessed to have a great influence on the urban development of Lang Son city in particular and Lang Son province in general. Therefore, in the coming time, along with the strong direction of the Provincial Party Committee and the Provincial People's Committee in site clearance work, supporting investors to complete procedures, an important requirement is that investors need to mobilize enough resources to implement the project, only then can we create a clear change, avoiding the trillion-dong project that has just been restarted after 17 years of "sleeping" and then falling into a "shelved" state.
“In the past, Lang Son city has been determined in site clearance for the Hoang Dong Hotel and Golf Course Project. However, to achieve the goal of completing the site clearance for the project by the end of June 2023, the city must be twice or three times more determined. In particular, all levels, sectors and organizations of the city need to focus on propaganda, mobilizing site clearance, and organizing individual propaganda to achieve high efficiency. For investors, the investor's responsibility is to coordinate with the city government and Hoang Dong commune to propagate and mobilize people to support the project and agree to hand over the site. Along with that, investors need to ensure financial resources for compensation and support for site clearance so that when the plan is approved, payments will be made to people in a timely manner; at the same time, resources must be arranged to implement the construction of project items, first of all, construction of the resettlement area immediately".
