Jealousy cases come in many forms and ways men and women deal with their girlfriends, boyfriends, wives, and husbands when they suspect or discover that they have been betrayed. There are situations that make you laugh, but there are also many cases that become criminal cases. Jealousy cases that require criminal prosecution like the above continue to be a warning against the thoughtless actions of adults who, out of jealousy, “lose their minds in anger.”
Act according to the law
According to the report on crime prevention and law violation in 2022, the crime situation is still complicated, some types of crimes that cause public outrage continue to increase. The most prominent is the increase in murder crimes by 13.17%, mainly due to personal conflicts and resentment. Among them, there are cases arising from jealousy conflicts.
Jealousy is a common occurrence when a marriage is unhappy and a third person intervenes. Violent "attacks" of jealousy help the jealous person to somewhat satisfy his anger, however, after each jealousy attack, the marriage will inevitably break down. The jealous person himself will suffer double damage when he is right but becomes wrong. Many people because of jealousy fall into legal trouble, become criminals and suffer severe punishments under the law.
From a legal perspective, lawyer Vu Van Tra, Director of Son Tra Law Firm, affirmed: For conflicts in marriage, the law only allows dialogue and reconciliation to resolve between the parties. Fighting and humiliating others because of jealousy is strictly prohibited by law. In any situation, each person needs to be calm, tactful in dealing with disagreements and conflicts in marriage and emotional relationships and act according to the law. Jealousy is absolutely not recommended because temporary anger can have serious consequences for both the jealous person and the victim.
Lawyer Vu Van Tra said: For acts of jealousy that have not yet reached the level of criminal prosecution, the jealous person may be administratively responsible for the actions he/she has committed. Specifically, for acts of humiliation of others that have not yet reached the level of criminal prosecution, he/she will be subject to administrative sanctions, warnings or fines from 2 million to 3 million VND (stipulated in Clause 3, Article 7 of Decree 144/2021/ND-CP dated December 31, 2021, stipulating sanctions for administrative violations in the fields of security, order and social safety; prevention and control of social evils; fire prevention and control; rescue; prevention and control of domestic violence). For the act of gathering many people in public places, causing disorder, the violator may be prosecuted for disturbing public order, and be administratively fined from 3 million to 5 million VND (stipulated in Clause 4, Article 7 of Decree 144/2021/ND-CP). For the act of violating the body or health of another person, the person who directly performs or hires another person to perform the act of jealousy, which infringes upon the body or health of another person, may be fined from 5 million to 8 million VND (stipulated in Clause 5, Article 7 of Decree 144/2021/ND-CP).
In case the act of jealousy is serious in nature and level, with all the elements constituting a crime, the person may be subject to criminal liability as prescribed in the Penal Code 2015, amended and supplemented in 2017. Depending on the nature, level, behavior, the crimes that the jealous person may face are: "Crime of intentionally causing injury or harm to the health of others", "Crime of humiliating others", even if the act is of a particularly serious level, directly infringing on the life of others, it can be prosecuted for the crime of "Murder" with the highest penalty being life imprisonment or death penalty.
