Are teachers banned from giving free extra lessons to elementary school students?

Providing free tuition for primary school students with colds is a problem that many teachers and parents are worried about.

Despite being busy at the end of the year, many parents still try to send their children to extra classes after a long day of regular schooling. Notably, not only middle and high school parents want their children to take extra classes, but even elementary school parents want their children to participate in this activity.

Article 4, Circular 29/2024 stipulates cases where extra teaching and organization of extra teaching are not allowed, including:

• Do not organize extra classes for primary school students, except for arts, sports , and life skills training.
• Teachers who are teaching at schools are not allowed to teach extra classes outside of school for money to students who are teaching regular classes.
• Teachers at public schools are not allowed to participate in the management and operation of extra-curricular teaching activities outside of school, but can participate in extra-curricular teaching outside of school.

Thus, teachers are not allowed to organize extra cultural classes for primary school students, whether in school or outside school, and whether they charge a fee or not. In case teachers violate the regulations on extra teaching and learning, depending on the nature and severity of the violation, they will be handled according to the provisions of law.

Private tutors must register their business.

Regarding extra-curricular teaching and learning activities, Article 6 of Circular 29/2024 stipulates each specific case and requires full implementation.

Accordingly, organizations or individuals that organize extra-curricular teaching and learning activities outside of school and collect fees from students must register their business according to the provisions of law. Publicize the subjects that are organized for extra-curricular teaching; the duration of extra-curricular teaching for each subject according to each grade level; the location, form, and time of organizing extra-curricular teaching and learning; the list of extra-curricular teachers and the amount of tuition collected before enrolling students for extra-curricular teaching and learning classes.

Extracurricular tutors must have good moral qualities and professional competence appropriate to the subjects they teach.

Teachers who are teaching at schools and participate in extracurricular teaching must report to the Principal, Director, or head of the school about the subjects, location, form, and time of extracurricular teaching.
