After the merger and implementation of the 2-level local government model, the Department of Education and Training will no longer exist in the education system. The Ministry of Education and Training has also issued Circular 12/2025/TT-BGDDT on decentralization, delegation and assignment of authority to perform state management tasks of 2-level local governments in the field of teachers and educational institution managers of the Ministry of Education and Training, which officially takes effect from July 1, 2025.
The new regulations will bring about significant changes in the management of teachers andeducational administrators. The most prominent highlight is the stronger empowerment of commune-level authorities, along with the streamlining of regulations, promising to create a more flexible and effective educational environment.
Strong decentralization to commune-level government
Previously, the organization of competitions for excellent teachers, excellent homeroom teachers, or excellent team leaders was usually under the authority of the Department of Education and Training (district level). However, according to Circular 12/2025/TT-BGDDT, this authority has been completely transferred to the People's Committee (PC) at the commune level.
Not only stopping at competitions, the Circular also gives more power to the People's Committee at the commune level in many other aspects of teacher management.
In particular, with the management of preschool teachers, many regulations on the working regime of preschool teachers that were previously under the authority of the district level are now transferred to the commune level.
The Circular also stipulates that the authority to use teachers and educational administrators who do not meet the standard qualifications will be similarly transferred from the district level to the commune level.
The phrase "district level" is replaced by "commune level" in circulars regulating codes, professional title standards, and appointment and salary classification of teaching staff in public preschool, primary and secondary schools.

Regarding the reward criteria, "excellent teachers from district level and above" and "certificates of merit from district level and above" are now replaced by "excellent teachers from commune level and above" and "certificates of merit from commune level and above" in job descriptions for preschool, primary and secondary school teachers.
In addition, the commune level also receives the previous authority of the district level regarding regulations on codes and professional title standards for student counselors.
In the working regime of general education and university preparatory teachers, the authority of the "District People's Committee" and "Head of the Department of Education and Training" is adjusted and now belongs to the "Commune People's Committee" and "Chairman of the Commune People's Committee".
Department of Education and Training has more great responsibilities
Besides strong decentralization to the commune level, the Department of Education and Training still plays a key role in managing and developing the quality of the team of managers and teachers.
According to the new Circular, the Department of Education and Training will be in charge of important contents such as: Authority to evaluate principals according to the standards of principals of general education and preschool education institutions; Authority to select key general education and preschool teachers.
In addition, the circular also streamlines regulations and abolishes provisions that are no longer appropriate to streamline processes and avoid overlap.
Circular 12/2025/TT-BGDDT applies to central state administrative agencies, local authorities, educational institutions and other relevant organizations and individuals.
Previously, in Official Dispatch No. 1581 last May, the Ministry of Education and Training requested that the provincial People's Committee only review and identify the state management contents of education at the district level that are being implemented to adjust and transfer to the provincial level (Department of Education and Training) or the commune People's Committee for management.
The Ministry recommends that provinces and cities carry out administrative activities related to education normally, smoothly, continuously without interruption, and without affecting the normal activities of society, people, and businesses.
State management contents in the field of education must be assigned to competent professional agencies to ensure the implementation of tasks related to deciding on job positions, financial norms, assigning staff and allocating budget for the education sector in the province.
Decentralization needs to be carried out strongly but without loosening management; ensuring that there is no omission, division or interruption of professional management contents and quality assurance conditions in the national education system.
The Ministry of Education and Training emphasized that state management of professional content, recruitment, arrangement, transfer, secondment and development of teaching staff should be assigned to the provincial professional agency (Department of Education and Training) to implement uniformly throughout the province. This is to ensure general regulation and timely handling of local teacher surplus and shortage among localities.
