On the afternoon of July 7, Prime Minister Pham Minh Chinh chaired an online meeting of the Government Standing Committee with Ho Chi Minh City to implement Resolution No. 98/2023/QH15 of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City.
Attending the meeting were comrades: Politburo member, Secretary of the Ho Chi Minh City Party Committee Nguyen Van Nen; Party Central Committee Secretary, Deputy Prime Minister Le Minh Khai; Party Central Committee members: Deputy Prime Minister Tran Hong Ha, Minister, Head of the Government Office Tran Van Son, Minister of Planning and Investment Nguyen Chi Dung, Minister of Education and Training Nguyen Kim Son, Minister of Science and Technology Huynh Thanh Dat, Minister of Natural Resources and Environment Dang Quoc Khanh, Chairman of the Ho Chi Minh City People's Committee Phan Van Mai; leaders of ministries, branches, central agencies and Ho Chi Minh City, Long An, Binh Duong, Dong Nai, Tay Ninh provinces.

44 specific mechanisms and policies for Ho Chi Minh City
In Resolution No. 31-NQ/TW dated December 30, 2022 on the direction and tasks of developing Ho Chi Minh City to 2030, with a vision to 2045, the Politburo assigned: "The Party Delegation of the National Assembly shall lead the issuance of a Resolution of the National Assembly (replacing Resolution No. 54/2017/QH14 of the National Assembly) to allow the piloting of outstanding mechanisms and policies for the development of Ho Chi Minh City. The Government Party Committee shall direct ministries and branches to coordinate with the City to complete the Project to issue a new Resolution on piloting outstanding mechanisms and policies for the development of the City to submit to the National Assembly".
On April 19, 2023, the Government issued Document No. 125/TTr-CP to submit to the National Assembly and the National Assembly Standing Committee a draft Resolution of the National Assembly. At the 5th Session of the 15th National Assembly (June 24, 2023), the National Assembly passed Resolution No. 98/2023/QH15 on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City, effective from August 1, 2023.

This Resolution received a very high consensus from the National Assembly deputies, with a 97.3% approval rate. The Resolution stipulates 44 specific mechanisms and policies, including 7 mechanisms inherited from Resolution No. 54/2017/QH14; 4 mechanisms issued for other localities; 6 mechanisms included in draft laws being submitted to the National Assembly and 27 mechanisms and policies applied only to Ho Chi Minh City. It can be said that this is the Resolution stipulating the largest number of specific mechanisms and policies ever passed by the National Assembly.
In the Resolution, the National Assembly assigned the Government 4 tasks.
Firstly, issue a Decree detailing 3 contents: (i) regulations on loan interest, reasonable profits, payment methods, and settlement of project implementation applying BT contracts; (ii) exemption of corporate income tax and personal income tax related to innovation and start-up activities in priority areas of the City; (iii) election, recruitment, management, and use of cadres and civil servants working in communes, towns, and ward cadres.
Second, organize a preliminary review of the implementation of the Resolution in 2026 and a final review in 2028.
Third, direct relevant agencies to coordinate with the City to reform administrative procedures, shorten the processing time for issues that have not been decentralized or delegated to the City.
Fourth, issue mechanisms and policies in accordance with authority to adjust and supplement appropriate regulations to resolve shortcomings arising in the practice of management and development of the City. Expand decentralization and authorization to the City People's Council and People's Committee compared to current regulations.

The Resolution assigns the Prime Minister 1 task: Promulgating regulations on decentralization, order and procedures for local adjustment of general planning for construction of functional areas, local adjustment of general urban planning, and local adjustment of specialized planning for technical infrastructure.
According to the assigned functions and tasks, the Ministry of Planning and Investment and the Ho Chi Minh City People's Committee have proactively and actively deployed and coordinated with relevant ministries and agencies to develop a draft Decree detailing the implementation of the National Assembly's Resolution.
Also according to the Resolution, relevant ministries and branches have 3 tasks, the HCMC People's Council has 14 tasks, and the HCMC People's Committee has 6 tasks.

Staff is the deciding factor
At the meeting, Minister of Planning and Investment Nguyen Chi Dung presented a report on the proposal to assign tasks to implement the Resolution of the National Assembly; Chairman of the Ho Chi Minh City People's Committee Phan Van Mai reported on preparations to implement the Resolution.
On behalf of the Party Committee, government and people of Ho Chi Minh City, Secretary of the Ho Chi Minh City Party Committee Nguyen Van Nen respectfully thanked the Party, State, Vietnam Fatherland Front and Central agencies for their comprehensive, close and timely attention to Ho Chi Minh City. In particular, the viewpoint of focusing on prioritizing the completion of outstanding and breakthrough institutions and policies through a pilot mechanism with Ho Chi Minh City is completely correct and necessary, receiving strong support.
Secretary Nguyen Van Nen said that the meeting between the Government Standing Committee and Ho Chi Minh City was very timely and tomorrow, the Ho Chi Minh City Party Committee will continue to hold a meeting to put the Resolution into practice. The People's Committee and People's Council of Ho Chi Minh City will also promptly issue documents according to their authority.
The Secretary of Ho Chi Minh City said that organizing the implementation of the Resolution is a difficult and challenging task, and in that process, the decisive factor is that cadres, people, and related agencies need to coordinate closely, and Ho Chi Minh City will do its best to achieve the best possible results.

Inherit, develop and innovate
Concluding the meeting, Prime Minister Pham Minh Chinh stated that it is necessary to determine that the implementation of the Resolution is not only for Ho Chi Minh City. If it is successfully implemented, the whole country will benefit. Therefore, this is a common task. The whole country must join hands with Ho Chi Minh City. Each person and each agency, based on their functions, tasks and powers, must perform well the assigned tasks in accordance with the direction of General Secretary Nguyen Phu Trong: "The whole country for Ho Chi Minh City, Ho Chi Minh City for the whole country".

The Prime Minister recalled that more than 40 years ago, to promote the development of Ho Chi Minh City, the Politburo issued Resolution No. 01-NQ/TW on April 14, 1982; on November 18, 2002, the Politburo issued Resolution No. 20-NQ/TW to replace it to meet practical requirements; followed by Resolution No. 16-NQ/TW on August 10, 2012. After 10 years of summarizing Resolution No. 16-NQ/TW, on December 30, 2022, the Politburo issued Resolution No. 31-NQ/TW on the direction and tasks of developing Ho Chi Minh City to 2030, with a vision to 2045. Thus, we carry out this work in the spirit of inheritance, development and breakthrough.
The Prime Minister welcomed and highly appreciated the Ministry of Planning and Investment, Ho Chi Minh City, and relevant ministries and branches for actively and responsibly implementing assigned tasks, proactively and seriously, to develop, synthesize, absorb, revise and perfect the draft Resolution to submit to the National Assembly at the 5th Session of the 15th National Assembly on time.
To fully and effectively implement the Resolution, in addition to specific provisions and provisions that can be applied immediately, the Government, the Prime Minister, ministries and agencies need to issue detailed regulations for implementation. Immediately after the Resolution was issued, the Ministry of Planning and Investment, relevant ministries and agencies and Ho Chi Minh City urgently reviewed and identified tasks for implementation. However, there are still many other tasks that the Government, the Prime Minister, ministries, agencies and Ho Chi Minh City need to urgently carry out.

Complete the guidance documents by August 2023 at the latest
The Prime Minister emphasized that the guiding ideology in implementing the Resolution is to be proactive, timely, closely follow the practical situation, take drastic actions and have specific products with measurable results, so that the people can truly benefit.
Regarding implementation, the Prime Minister agreed with Ho Chi Minh City's idea to immediately establish a Steering Committee to implement the Resolution, with the Prime Minister as Head of the Committee and the Deputy Secretary of the City Party Committee as Permanent Deputy Head of the Committee; assigning the Ministry of Planning and Investment as the focal agency. The Prime Minister requested the immediate issuance of the Government's Action Plan, in which tasks are clearly assigned and the Deputy Prime Ministers are in charge. These two documents must be issued in the next few days.
The Prime Minister assigned the Ministry of Planning and Investment to preside over and coordinate with the Government Office and Ho Chi Minh City to review the contents that need to be issued a Decree, then advise the Government to issue it according to the shortened procedures, along with assigning ministries and branches to preside over and Deputy Prime Ministers in charge of the field to directly direct. Ministries and branches must also promptly issue Circulars and guiding documents within their authority with shortened procedures. The above tasks are expected to be completed this month, no later than August 15.
Regarding the content under the authority of the Prime Minister, the Ministry of Construction will preside over and coordinate with Ho Chi Minh City to advise and develop a draft Decision of the Prime Minister to submit to the Prime Minister for promulgation this July.
The Ministry of Planning and Investment shall preside over and coordinate with the Government Office and Ho Chi Minh City to review and issue a Decree for the contents requiring the Government to issue according to the shortened procedures and order, along with assigning ministries and branches to preside over and Deputy Prime Ministers to directly direct the handling of issues with different opinions. If there are any problems, they shall report to the Prime Minister. Ministries and branches shall promptly issue circulars and guiding documents according to their authority and the shortened procedures and order. These tasks are expected to be completed in August 2023.

The Prime Minister requested that during the implementation process, it is necessary to regularly inspect and urge; if difficulties and problems arise, continue to issue guiding documents; request that press agencies focus on encouraging, cheering, motivating, and accompanying the Government, Ho Chi Minh City and ministries and branches in the process of implementing and deploying the Resolution.
The Prime Minister emphasized his determination to carry out and believed that he would successfully implement the special mechanisms and policies for the development of Ho Chi Minh City, and successfully implement the Resolution of the Politburo and the National Assembly.
