Cancel the auction results of 3 mineral mines

The reason given by the People's Committee of Thanh Hoa province for canceling the auction results of the sand mine in Cam Ngoc commune, Cam Thuy district is because the auction on August 17, 2023 was unsuccessful.

According to the provisions of Clause 8, Article 5, Point c, Clause 1, Article 52 of the Law on Property Auction, all bids are invalid. Based on current legal regulations, the People's Committee of Thanh Hoa province assigns the Department of Natural Resources and Environment (TNMT) to take effect after the regulations on auctioning mineral exploitation rights under the licensing authority of the People's Committee of the province are adjusted and come into effect.

Thanh Hoa Provincial People's Committee also issued Decision No. 3327/QD-UBND to cancel the auction results of the right to exploit sand mines in Luong Ngoai Commune, Ba Thuoc District, which was held on August 17, 2023. The reason for canceling the auction results was that Thai Binh Construction Group Joint Stock Company (the auction winner at the price announcement) submitted a request on August 18, 2023 to cancel the auction results of the right to exploit sand mines.

The Department of Natural Resources and Environment (the owner of the auctioned property), the Property Auction Service Center (the property auction organizer) and Thai Binh Construction Group Joint Stock Company (the auction winner) signed an agreement to cancel the auction result on August 21, 2023.

The Department of Natural Resources and Environment is assigned to notify the Thanh Hoa Property Auction Service Center to deposit the deposit of Thai Binh Construction Group Joint Stock Company when participating in the auction of the above sand mine, which is VND 1,309,923,000, into the State budget according to current regulations of law.

After the regulations on auctioning mineral exploitation rights under the licensing authority of the Provincial People's Committee issued together with Decision No. 3029/2017/QD-UBND dated August 17, 2017 of the Provincial People's Committee are adjusted and come into effect, the Department of Natural Resources and Environment is assigned to urgently advise and submit to the Provincial People's Committee for approval to adjust a number of contents in the auction plan for sand mines in Cam Ngoc commune, Cam Thuy district and sand mines in Luong Ngoai commune, Ba Thuoc district to continue to carry out the auction of mineral exploitation rights, ensuring full compliance with current legal regulations.

The People's Committee of Cam Thuy district and the People's Committee of Ba Thuoc district, according to their assigned functions, tasks and authorities, shall organize the management and protection of the sand mine in Cam Ngoc commune and the sand mine in Luong Ngoai commune, Ba Thuoc district according to the provisions of law; take full responsibility before the law and the Provincial People's Committee if illegal mineral exploitation activities occur.

In addition, Vice Chairman of the Provincial People's Committee Nguyen Van Thi also signed Decision No. 3326/QD-UBND to cancel the auction results of the right to exploit minerals from the land fill mine in Thang Binh commune and Tuong Linh commune, Nong Cong district for HHD Mining Engineering Joint Stock Company recognized by the Provincial People's Committee in Decision No. 2072/QD-UBND dated June 14, 2023.

Reason for cancellation: HHD Mining Engineering Joint Stock Company (the auction winner at the price announcement) issued a document dated August 22, 2023 requesting to cancel the auction results for the right to exploit the above-mentioned land fill mine; The Department of Natural Resources and Environment (the owner of the auctioned property), the Property Auction Service Center (the property auction organizer) and HHD Mining Engineering Joint Stock Company (the auction winner) signed an agreement dated September 7, 2023 on canceling the auction results for the right to exploit the land fill mine in Thang Binh commune and Tuong Linh commune, Nong Cong district.
