9th Session, 15th National Assembly: Ensuring policy beneficiaries are consistent with the reality of law-making

Discussing the draft Resolution of the National Assembly on a number of special mechanisms and policies to create breakthroughs in law making and enforcement on the morning of May 16, National Assembly deputies basically agreed with the necessity of issuing the Resolution; affirming that the mechanisms and policies will create motivation to improve the quality of law making and law enforcement activities.

Delegate Pham Van Hoa (Dong Thap) commented that it is necessary to set up preferential policies and appropriate training for the staff directly involved in the development and staff advising competent authorities in the development of policies and laws, contributing to enhancing the responsibility and working spirit of this team; avoiding the risk of bringing "group interests" into the development and implementation of policies and laws.

Commenting on the content of the special financial mechanism and policy for law-making work, delegate Pham Van Hoa expressed his high agreement with the provisions of the draft Resolution. Accordingly, the state budget ensures that spending on law-making work is not lower than 0.5% of the total annual state budget expenditure and gradually increases according to development requirements.

Regarding the allocation of expenditures in law-making work, delegates proposed that the Government should prescribe a list of tasks, activities and allocation rates for each task and activity of drafting legal documents.

Emphasizing the need to ensure that the beneficiaries of the policy according to the draft Resolution are consistent with the reality of law-making and law enforcement, delegate Dang Thi My Huong said that Clause 6, Appendix 1 of the draft Resolution stipulates that the beneficiaries of monthly support are full-time People's Council delegates of the Legal Committee of the Provincial People's Council, which is not consistent with the reality of the work.

According to the delegate, full-time provincial People's Council delegates have the same job, they are all people who carry out the work of reviewing and drafting resolutions of the provincial People's Council, supervising legal documents in the locality according to the functions and tasks of the provincial People's Council Committees.

Based on the assignment and direction of the Standing Committee of the Provincial People's Council, full-time delegates of the Provincial People's Council Committees all coordinate in the work of examining and supervising the drafting of resolutions of the Provincial People's Council, not only full-time delegates of the Legal Committee perform this work.

Therefore, the delegate suggested that it is necessary to add the subject of full-time People's Council delegates of the Provincial People's Council Committees to enjoy this policy to ensure fairness among the subjects enjoying the policy. At the same time, it is necessary to study and add the subject of civil servants who directly advise and assist the Committees of the Provincial People's Council and the Standing Committee of the Provincial People's Council because this subject often directly advises on the work of examining and drafting resolutions of the Provincial People's Council, and advises on the work of supervising the implementation of laws in the locality.

In order to ensure the implementation of institutional reform goals, in harmony with the new regulations of the National Assembly and the Government on budget expenditures, delegate Nguyen Thi Suu (Hue city) proposed adding to Article 4 of the draft Resolution the provision: "The use of the budget attached to this Resolution must be independently audited; annual settlement must be made public; ensuring close supervision by the National Assembly, the National Assembly Standing Committee, inspection, auditing and auditing agencies and the whole society".

Regarding the content of developing, applying digital technology, digital transformation to serve innovation and modernization of law-making and law enforcement, delegate Nguyen Thi Suu suggested that, in addition to the digital technology application activities mentioned in the draft Resolution, it is necessary to study and clarify some contents such as the role of digital technology in training and coaching officials and civil servants; monitoring, inspecting and evaluating the effectiveness of law enforcement. Along with that, it is necessary to study and supplement digitalization regulations in some stages such as consultation, collecting opinions on propaganda, dissemination, legal education, supervision, social criticism, etc.
