Dong Nai Newspaper discussed with Mr. Le Thanh Tuan, Director of the Provincial Land Registration Office, about this issue when the two-level government comes into operation.
All land procedures can be done at the commune and ward level.
* From July 1, the local government model will have only 2 levels (province and commune, ward), no more district level. So how will the first issuance of red books or transfers to households and individuals be carried out, sir?
- The procedures for granting red books are mainly of two types: first-time issuance and change registration (transfer of rights, change adjustment). For individuals, up to now, the first-time issuance procedures have been handled by the district-level People's Committee. When the district level is not organized, according to the draft decree of the Government , the competent authority will be the People's Committee of the commune or ward.
For registration procedures for changes such as: transfer, donation, inheritance, mortgage, change of information..., the Provincial Land Registration Office and its branches will handle them.
When needed, people prepare complete documents and choose the following forms of submission: online submission via the Public Service Portal, direct submission at the one-stop department of the province or commune level, and submission via postal service.
Thus, when not organized at the district level, most procedures are received and results are returned at the People's Committees of communes and wards to ensure closer proximity to the people, and the processing time will be faster.
* Currently, all communes and wards have one-stop departments. After July 1, can people continue to submit applications for transfer and issuance of red books at the commune/ward one-stop department?
- Absolutely. Previously, the commune-level one-stop department was an "extended arm" of the district-level People's Committee and the Provincial Land Registration Office; in the near future, the commune-level one-stop department will directly perform this task (receiving and returning results).
In the future, according to the direction of the Central and the province, the People's Committees of communes and wards will have public administrative service centers to receive and return results of administrative procedures, including administrative procedures on land and issuance of red books.

* Sir, from July 1, many communes and wards will merge and change their names. In this case, do households and individuals have to adjust their red books to the new commune or ward name?
- Regarding this content, the Ministry of Agriculture and Environment has commented that when arranging administrative units, people do not necessarily have to adjust the red book, except in cases where land users have a need. The existing red book is still legally valid. The adjustment of commune and ward name information will be carried out simultaneously when people carry out transactions and procedures on land use rights.
We also request that agencies such as notaries, banks, etc., when carrying out procedures related to land, create conditions for people to confirm.
Ensure good settlement of land records when merging provinces
* When merging the two provinces of Dong Nai and Binh Phuoc, the number of new red book applications and registration changes may increase. What has the provincial Land Registration Office prepared to avoid congestion?
- Implementing the direction of the Provincial People's Committee and the Department of Agriculture and Environment, the Provincial Land Registration Office is focusing on re-editing maps and cadastral records to serve the 2-level government model.
The Provincial Land Registration Office has contacted the Binh Phuoc Provincial Land Registration Office to review the map system, cadastral records, database, volume of records, work and administrative procedure settlement process. Through working between the two offices and related units, an agreement was reached on the land database management software and administrative procedure settlement process to ensure consistency, smoothness and efficiency when merging.
In the future, to facilitate people and businesses in the implementation process, Dong Nai province will continue to expand the form of online and non-territorial land administrative procedure settlement. People and businesses can choose the place to submit documents and receive results at the nearest and most convenient place.
* Could you tell us, up to now, what percentage of households and individuals has Dong Nai granted red books?
- For many years, the province has been interested in and directed the issuance of red books to the people. By 2019, the province had basically completed the issuance of red books for the first time for land plots eligible for issuance. For the remaining proportion that is not eligible due to disputed land, encroached land, unverified origin, etc., every year, the People's Committees at the district level and in the future, the People's Committees at the commune and ward levels will continue to deploy for people to declare, register and organize the review and issuance of red books for cases that meet the conditions according to regulations.
* How is the application of technology in land management and certificate issuance at the Provincial Land Registration Office carried out, sir?
- With the attention of the Provincial People's Committee, the Department of Agriculture and Environment has deployed the application of information technology in surveying, cadastral mapping, and building land databases since the year 2000.
Up to now, Dong Nai has basically completed all digital cadastral maps, completed the land database, centralized operation, serving state management, resolving administrative procedures for people and businesses, publicizing and transparent information. In addition, the province has directed to continue cleaning land data to connect with the National Population Database (currently, through reconciliation, it has reached over 80%).
