Livestream sales must verify identity, prohibit false information about products

The draft Law on E-commerce proposes that livestreamers must verify their identities and strictly prohibit the act of providing false information about product uses and prices.

On the morning of September 22, continuing the 49th session, the National Assembly Standing Committee gave opinions on the draft Law on E-commerce.

Presenting the Government 's proposal, Deputy Minister of Industry and Trade Nguyen Sinh Nhat Tan said that the draft Law consists of 8 chapters and 50 articles, which stipulate 4 models of e-commerce activities including: Direct business e-commerce platform; intermediary e-commerce platform; social network for e-commerce activities; multi-service integration platform.

Deputy Minister Nguyen Sinh Nhat Tan said that one of the new points in this draft is the regulation on "identifying sellers". Accordingly, the owner of the e-commerce platform is responsible for identifying domestic sellers through VNeID, while foreign sellers must be identified through documents proving their legality.

Regarding livestream sales activities, the draft law specifically stipulates the responsibilities of e-commerce platform owners, sellers and livestream sellers. Specifically:

The owner of the e-commerce platform in livestream sales activities is responsible for authenticating the identity of the livestreamer according to the law on electronic identification and authentication.

Platform owners need to publicize and implement mechanisms and measures to control real-time livestream sales content, and immediately take measures to prevent, stop streaming, and remove displayed information and links when detecting content that violates the law or social ethics.

The government also expects platform owners to take measures to prevent livestream sales of prohibited goods and services. In cases where livestream sales contain content that may affect the physical and mental health of minors, platforms must provide prominent warnings before displaying the information.

Platforms are also responsible for storing and ensuring accessibility to electronic data information containing images and sounds of livestream sales activities for at least 1 year from the time of commencement of broadcasting.

For sellers (owners of goods and services) , the draft law requires livestreamers to provide documents proving that the goods and services meet business conditions. At the same time, sellers must also provide product information such as: name, origin, manufacturer and importer information, conformity marks, instructions for use, safety warnings, production date, and expiry date.

Sellers also need to provide livestreamers with information about goods and services, including mandatory content shown on product labels as prescribed by law, except for information that is specific to the product, including: date, month, year of manufacture; expiry date; production batch number; frame number, engine number; performance standards to be achieved in providing products, goods, and services; documents proving compliance with investment and business conditions.

The draft law also stipulates that for products requiring a written confirmation of advertising content from a competent authority, sellers are only allowed to livestream after receiving this document and the livestream content must be consistent with the confirmed content.

For livestreamers (people who directly appear and introduce products) , according to the Government's proposal, information must be provided to the owner of the e-commerce platform to serve electronic identification and authentication.

Livestreamers are prohibited from providing false or misleading information about the uses, origin, quality, prices, promotions, warranty policies and other content related to goods and services.

At the same time, implement the advertising content that has been confirmed by the competent authority for goods and services that are required by law to confirm advertising content. Ensure that the use of language, images, costumes, and behaviors does not violate social ethics and customs during the livestream sales process...

Examining the draft Law on E-commerce, Chairman of the Economic and Financial Committee Phan Van Mai proposed clearly defining the scope and content of "e-commerce activities"; reviewing and clarifying regulations corresponding to the characteristics of goods purchase and sale contracts compared to service provision contracts.

The Standing Committee of the Economic and Financial Committee also proposed not to re-regulate the content that has been stipulated in general laws or laws governing other sectors and fields, not to create overlaps, duplications, contradictions, or legal conflicts, not to generate unnecessary administrative procedures, and not to create legal problems in the implementation process.
