Some private clinics in Ho Chi Minh City use the word “hospital” in their advertisements and signs, posing potential risks to the quality and effectiveness of medical examination and treatment at these facilities.

According to the Ho Chi Minh City Department of Health , when looking up information about businesses in the area, it shows that there are currently at least 184 private businesses using the name when registering for business certificates at the Department of Planning and Investment with the word "hospital", but do not operate according to the hospital model.

Among them, there are businesses that, when registering administrative procedures to establish a clinic, are forced by the Department of Health to grant a license with the name containing the phrase "hospital" because the clinic is registered to take the name of the business printed in the business certificate issued by the Department of Planning and Investment.

However, the Law on Medical Examination and Treatment and Decree No. 96/2023/ND-CP clearly stipulate the organizational forms and conditions for granting operating licenses to medical examination and treatment facilities. Accordingly, the licensing conditions for “hospitals” and “clinics” are different in terms of scale, facilities, organizational structure, personnel and other conditions.

This is to ensure transparency and accountability of each medical facility. Therefore, the use of the word “hospital” in the name of clinics is not only inconsistent with their functions and duties, but also affects the rights and trust of the people.

According to the Department of Health Inspectorate, from January 1, 2024 to present, there have been 10 business establishments that registered the word “hospital” in their business names in violation of the law. Of these, 6 specialized clinics were administratively sanctioned. In addition, there is 1 cosmetic practice facility, but it does not have a license to operate medical examination and treatment.

Faced with the above situation, the Ho Chi Minh City Department of Health recommends that ministries, branches and relevant units consider and supplement regulations on naming medical facilities, to overcome the situation where businesses providing clinic services use the name "hospital".

While waiting for competent authorities to adjust relevant regulations, the Ho Chi Minh City Department of Planning and Investment and local finance and planning departments need to tighten the appraisal process and refuse to grant licenses to businesses and business households whose registered names do not comply with the organizational form prescribed in Clause 1, Article 48 of the Law on Medical Examination and Treatment.

At the same time, the Department of Health recommends that private enterprises that have registered the name "hospital" but do not have the scope of operation to be a hospital should adjust their names and not continue to use the word "hospital" in their names.

“In the coming time, the Department will continue to coordinate with relevant departments, agencies and local authorities to strengthen inspection and examination activities of private medical examination and treatment facilities. Thereby, it will strictly handle facilities that have violations or intentionally violate many times, especially clinics that regularly receive feedback and complaints from people,” the Department of Health informed.

The ambiguity in the use of the name “hospital” by private clinics is currently a social problem that needs to be promptly resolved. The Ho Chi Minh City Department of Health calls on people to choose reputable hospitals and clinics that have been granted operating licenses by the Ministry of Health or the Department of Health.
