The dark side of e-commerce and solutions to prevent it for healthy development

Ministry of Industry and Trade deploys 5 solutions to accelerate e-commerce Tax collection through e-commerce platforms: An arduous journey

According to the Department of E-commerce and Digital Economy (Ministry of Industry and Trade), through investigation and survey by the Ministry of Industry and Trade, retail e-commerce revenue in Vietnam in 2022 is estimated to grow by 20% compared to 2021, reaching 16.4 billion USD, accounting for 7.5% of retail revenue of goods and consumer services nationwide.

The number of consumers participating in online shopping is over 54.6 million people, the value of online shopping per person reaches nearly 270 USD/year. In the first 6 months of 2023, Vietnam's retail e-commerce sales are estimated to reach 10.3 billion USD, an increase of about 25% over the same period, accounting for 7.7% of the country's revenue from consumer goods and services.

Many forms of online sales have appeared such as selling via Facebook, Zalo, ... Diverse sales in many forms have contributed positively to promoting the production and consumption of goods, especially goods produced in Vietnam. Although growing rapidly, strongly and bringing many advantages to consumers and businesses, according to the National Steering Committee 389, e-commerce has its downside. That is the situation of counterfeit goods, poor quality goods, smuggled goods, goods of unknown origin being sold widely on floors and social networking sites more and more.

Consumers sometimes believe too much in improper marketing advertisements, just because the profits of a part of organizations and individuals doing business online have been damaged by wrongdoings, deceiving customers with many tricks. "This is a painful problem of society, affecting the rights of consumers, the investment and business environment, causing budget losses".

In 2022, the authorities detected, arrested, and handled 139,758 violations (an increase of 1.17% over the same period in 2021). Of which, units and localities detected and arrested 3,692 cases of production, trading, and transportation of counterfeit goods, poor quality goods, and goods violating intellectual property rights (an increase of 56.51% over the same period in 2021).

In the first 6 months of 2023, there were 66,049 violations (an increase of 22.1% over the same period in 2022). Of which, there were 2,219 cases of buying, selling, and transporting prohibited and smuggled goods (down 9.72% over the same period); 61,057 cases of trade fraud and tax fraud (up 20.55% over the same period); 2,773 cases of counterfeit goods and intellectual property violations (up 174.01% over the same period); collected more than VND 6,560,609 billion for the state budget (up 76.23% over the same period); 1,166 cases/1,610 subjects were prosecuted.

However, the above results do not fully reflect the actual situation. The National Steering Committee 389 emphasized: The situation of trading in counterfeit goods, fake goods, intellectual property infringement... on e-commerce platforms is still potentially complicated. In the face of the above situation, which is considered quite serious, it is clear that state management agencies on domestic trade need to have effective solutions to promptly prevent unethical trading behaviors, contrary to conscience, and society, violating the legitimate rights of consumers.

In the coming time, the following basic solutions are needed: On the part of specialized management agencies such as: National Steering Committee 389, Department of E-commerce and Digital Economy, General Department of Market Management under the Ministry of Industry and Trade. Economic Police, Ministry of Information and Communications , ... need to review documents regulating commercial practice through digital platforms, to supplement or replace regulations to manage this field more closely, transparently and disciplined. Investigative organizations grasp the situation and promptly handle violations, especially large business organizations.

Regarding local areas, all activities of business organizations and individuals in the area must be grasped right at the base to coordinate with sectors and levels to promptly handle violations as soon as they arise. Protect businesses that do business honestly and seriously.

Associations related to e-commerce such as the Association for the Protection of Consumer Rights, the Vietnam Retailers Association, the Association of Small and Medium Enterprises, etc. need to proactively grasp the activities of their members in this field to promptly correct, rectify and handle violations within the scope of their charter.

Finally, the coordination and implementation of relevant levels and sectors in this activity must be smooth, consistent and effective in order to contribute to preventing the negative aspects of the current rapidly developing commercial activities in order to improve the health of buying and selling relations in the market, protect legitimate businesses and the legitimate rights of consumers in 2023 and the following years.
