Can someone who has only finished 7th grade be called up for military service?

Military service is a duty that citizens must fulfill according to the law. Every year, the recruitment and conscription of citizens into the military is carried out to supplement the numbers of regular units and to replace troops as stipulated by law, creating a strong and high-quality reserve force; making a significant contribution to enhancing the combat strength of the Army and firmly defending the Fatherland in all situations.

According to Clause 4, Article 4 of Circular 148/2018/TT-BQP of the Ministry of National Defense , which stipulates the educational standards for military recruitment, citizens with an education level of 8th grade or higher are selected and enlisted, in descending order of educational level. Localities facing difficulties in meeting the assigned recruitment quota may report to the competent authority for consideration and decision on the recruitment of citizens with an education level of 7th grade.

According to this circular, communes in remote areas, areas with particularly difficult socio -economic conditions as defined by law, and ethnic minority communities with fewer than 10,000 people may recruit no more than 25% of citizens with primary school education, while the remainder must have secondary school education or higher.

Therefore, depending on the region, a citizen with only a 7th-grade education may or may not be eligible for military service.

Cases of temporary deferment or exemption from military service.

According to Article 41, Section 2, Chapter IV of the 2015 Military Service Law on temporary deferment and exemption from military service, the following citizens are subject to temporary deferment of military service:

a) Not fit for military service according to the conclusion of the Medical Examination Board;

b) Being the sole breadwinner directly supporting dependents who are unable to work or are not yet of working age; or belonging to a family that has suffered severe losses of life and property due to accidents, natural disasters, or dangerous epidemics, as confirmed by the People's Committee at the commune level;
c) A child of a war invalid or a person exposed to Agent Orange with a reduced working capacity of 61% to 80%;

d) Having a sibling who is a non-commissioned officer or soldier currently serving in the military; or a non-commissioned officer or soldier performing compulsory service in the People's Public Security Force;

d) Persons subject to relocation or resettlement within the first three years to particularly disadvantaged communes under the State's socio-economic development project decided by the Provincial People's Committee or higher;

e) Officials, civil servants, public employees, and volunteer youth who are assigned to work in areas with particularly difficult socio-economic conditions as prescribed by law;

g) Currently studying at a general education institution; currently undergoing full-time undergraduate training at a higher education institution, or full-time college-level training at a vocational education institution for the duration of one training course of a particular educational level.

The following citizens are exempt from military conscription:

a) Children of martyrs, children of first-class wounded soldiers;

b) A brother or younger sibling of a fallen soldier;

c) One child of a second-class war invalid; one child of a war invalid with a disability rating of 81% or higher; one child of a person exposed to Agent Orange with a disability rating of 81% or higher;

d) Personnel working in cryptography who are not military personnel or members of the People's Public Security Force;

d) Officials, civil servants, public employees, and volunteer youth who are assigned to work in areas with particularly difficult socio-economic conditions as prescribed by law for 24 months or more.

Citizens who are subject to temporary deferment of military service as stipulated in Clause 1 of this Article, if the reason for deferment no longer exists, shall be called up for military service.

Citizens who are eligible for temporary deferment or exemption from military service as stipulated in Clauses 1 and 2 of this Article, if they volunteer, will be considered for selection and conscription.

The list of citizens eligible for temporary deferment or exemption from military service must be publicly posted at the headquarters of the People's Committee at the commune level, agencies, and organizations for a period of 20 days.
