The National Assembly voted to pass the Resolution of the National Assembly amending and supplementing a number of articles of the 2013 Constitution.
Accordingly, Article 110 of the Constitution is amended and supplemented as follows: Administrative units of the Socialist Republic of Vietnam are organized into two levels, including provinces and centrally run cities and administrative units below provinces and centrally run cities as prescribed by law.
Special administrative- economic units established by the National Assembly.
The establishment, dissolution, merger, division, and adjustment of administrative boundaries must consult local people and follow the order and procedures prescribed by the National Assembly.
In addition, the National Assembly amended and supplemented Article 111 of the Constitution as follows: Local governments are organized in administrative units of the Socialist Republic of Vietnam.
Local government levels include People's Councils and People's Committees organized in administrative units suitable to the characteristics of rural, urban and island areas as prescribed by the National Assembly.
Local authorities in special administrative-economic units are prescribed by the National Assembly when establishing such special administrative-economic units.
Amending regulations on the Vietnam Fatherland Front and its affiliated socio- political organizations
The National Assembly amends and supplements Article 9 of the Constitution as follows: The Vietnam Fatherland Front is a political alliance organization, a voluntary union of political organizations, socio-political organizations, social organizations and typical individuals in social classes, strata, ethnic groups, religions, and Vietnamese people residing abroad.
The Vietnam Fatherland Front is part of the political system of the Socialist Republic of Vietnam, led by the Communist Party of Vietnam; is the political base of the people's government; gathers and promotes the strength of great national unity; expresses the will, aspirations and promotes the mastery of the people; represents and protects the legitimate and legal rights and interests of the people; practices democracy, strengthens social consensus; supervises and provides social criticism; reflects the opinions and recommendations of the people to state agencies; participates in Party and State building and people's foreign affairs activities, contributing to building and defending the Fatherland.
Vietnam Trade Union, Vietnam Farmers' Association, Ho Chi Minh Communist Youth Union, Vietnam Women's Union, Vietnam Veterans' Association are socio-political organizations under the Vietnam Fatherland Front, established on a voluntary basis, representing and protecting the legal and legitimate rights and interests of their members; organized and operating uniformly within the Vietnam Fatherland Front; together with other member organizations of the Democratic Consultative Front, coordinating and unifying actions chaired by the Vietnam Fatherland Front.
The Vietnam Fatherland Front, its member organizations and other social organizations operate within the framework of the Constitution and the law. The State creates conditions for the Vietnam Fatherland Front, its member organizations and other social organizations to operate.
Amend and supplement Article 10 as follows: The Vietnam Trade Union is a political and social organization of the working class and laborers; represents, cares for and protects the legitimate and legal rights and interests of union members and laborers; is the sole representative of laborers at the national level in labor relations and international relations on trade unions; participates in state management, socio-economic management; participates in inspection, supervision and monitoring of the activities of state agencies, organizations, units and enterprises on issues related to the rights and obligations of laborers; propagates and mobilizes laborers to study, improve their qualifications and professional skills, comply with the law, build and defend the Fatherland.
In addition, the National Assembly amended and supplemented Clause 1, Article 84 as follows: The President, the National Assembly Standing Committee, the Nationalities Council, the National Assembly Committees, the Government, the Supreme People's Court, the Supreme People's Procuracy, the State Audit, the Central Committee of the Vietnam Fatherland Front and the central agencies of socio-political organizations have the right to submit draft laws to the National Assembly and draft ordinances to the National Assembly Standing Committee.
End of operations of district-level administrative units nationwide from July 1, 2025
The Resolution also clearly states that the operation of district-level administrative units nationwide will end from July 1, 2025.
When consolidating the organizational apparatus of agencies after implementing the administrative unit arrangement and ending the operation of district-level administrative units in 2025, the election of the positions of Chairman, Vice Chairman of the People's Council, Head of the People's Council Committees, Chairman, Vice Chairman, and member of the People's Committee in the administrative unit formed after the arrangement shall not be conducted; the Head and Deputy Head of the National Assembly Delegation of the provinces and centrally run cities formed after the arrangement shall not be elected. Based on the notification of the Party Committee with authority to manage cadres, the National Assembly Standing Committee shall appoint the Chairman, Vice Chairman of the People's Council, Head of the People's Council Committees, Head and Deputy Head of the National Assembly Delegation in the provinces and centrally run cities formed after the arrangement; the Prime Minister shall appoint the Chairman and Vice Chairman of the People's Committee in the provinces and centrally run cities formed after the arrangement; The Standing Committee of the People's Council of a province or centrally run city shall appoint members of the People's Committee of the same level and appoint the Chairman, Vice Chairman of the People's Council, Heads of Committees of the People's Council, Chairman, Vice Chairman of the People's Committee of the lower-level administrative unit formed after the rearrangement; The Standing Committee of the People's Council of an administrative unit below the province or centrally run city formed after the rearrangement shall appoint members of the People's Committee of the same level. In special cases, it is allowed to appoint personnel who are not People's Council delegates to hold the positions of Chairman, Vice Chairman, Heads of Committees of the People's Council of the administrative unit formed after the rearrangement or to act as People's Council delegates to form provisional People's Councils in wards implementing the urban government model without organizing People's Councils.
