Specifically, the delegates proposed that the drafting agency replace the regulation prohibiting the absolute prohibition of "buying and selling personal data" with a prohibition on buying and selling data without the consent of the data subject or for illegal purposes; adding that cases where data subjects voluntarily share their data to receive benefits will not be considered a violation, if they comply with data protection principles.

Discussing in the group, Senior Lieutenant General Tran Quoc To, Permanent Deputy Minister of Public Security (Bac Ninh Delegation) said that personal data is an important resource in socio-economic development, serving innovation, contributing to ensuring security and order.

In the legal system, there are currently 68 legal documents directly related to personal data protection. However, the implementation process has shown shortcomings, requiring adjustment and revision.

“For example, there are no criminal sanctions regulating the protection of personal data, the buying and selling of personal data, nor are there any administrative sanctions for violations of personal data protection,” said delegate Tran Quoc To.

In fact, in recent times, there has been a phenomenon of many organizations and businesses collecting “excess” personal data compared to their industries, products, and business services. Meanwhile, the activities of collecting and processing data by organizations, individuals, and bad actors without the consent of the subjects have seriously violated the rights and legitimate interests of citizens.

From the above analysis, Senior Lieutenant General Tran Quoc To said that unifying the adjustment of issues related to personal data protection in the draft Law will create a synchronous legal corridor, resolving the lack of uniformity in current regulations.

Delegates suggested that the drafting agency continue to review and revise regulations on cases of cross-border data transfer, ensuring consistency, compatibility with international practices, and ensuring that they are easy to understand and apply, without creating barriers to administrative procedures.

"To ensure state management, the draft Law stipulates a specialized agency and specialized force for personal data protection, which is necessary and appropriate," said the delegate.

Meanwhile, delegate Tran Viet Anh (Hanoi delegation) suggested that the drafting agency add the viewpoints of Resolution 57-NQ/TU of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation to the content of the draft Law. According to the delegate, personal data is both a property resource and a resource for science and technology development.

Delegate Tran Van Tien (Vinh Phuc Delegation) said that the context of widespread digital transformation requires a mechanism to protect personal data rights; prevent and strictly handle acts of personal data infringement.

“The Government’s submission to the National Assembly of the draft Law on Personal Data Protection is necessary to complete and create a comprehensive legal basis for personal data protection. Thereby, it contributes to raising awareness and responsibility of agencies, organizations and individuals in using personal data in accordance with the law, serving socio-economic development,” the delegate said.

Regarding the scope of regulation and applicable subjects, many National Assembly deputies proposed clarifying the limits of personal data of Vietnamese citizens and foreigners in Vietnam as well as the scope of personal data processing within and outside Vietnam. This helps to determine the applicable subjects appropriately, avoiding confusion or omissions.
