Regarding the case of 160 students of Kinh Bac University receiving "illegal" graduation certificates, speaking with Dan Viet newspaper reporter, Associate Professor Dr. Nguyen Van Hoa confirmed this information.

Recent,   Kinh Bac University (located at Phuc Son Street, Vu Ninh Ward, Bac Ninh City, Bac Ninh Province) posted on its website that the university diploma signed by Mr. Pham Ngoc Truc and awarded to the new graduates of the second batch of 2024 was not within its authority.

The above information caused a stir in public opinion, especially the 160 new graduates who had just been awarded their degrees were extremely worried.

Kinh Bac University is a private university under the Ministry of Education and Training, established under Decision No. 350-QD/TTg dated March 26, 2012 of the Prime Minister .

Speaking to Dan Viet newspaper reporters, Associate Professor Dr. Nguyen Van Hoa - still introduced on the school's website as the Principal of Kinh Bac University - confirmed the above information and said: "The university diploma of Kinh Bac University was signed by Mr. Pham Ngoc Truc and issued without proper authority. The school will withdraw it and carry out procedures to issue official diplomas to students, protecting the rights of learners. The school will resolve it as soon as possible."

Mr. Hoa also affirmed: "The Chairman of the Board of Directors of Kinh Bac University is Mr. Doan Xuan Tiep and the Principal of Kinh Bac University is me. The school has announced the postponement of the Graduation Ceremony and the opening of the 2024-2025 school year to ensure the legitimate rights and interests of students, especially the issue of the student's graduation certificate must be signed and issued by an authorized person according to the provisions of Circular No. 21/2019/TT-BGDDT dated November 29, 2019 and other relevant legal documents".

According to the information document about 160 students of Kinh Bac University receiving "illegal" graduation certificates, the school said that although there was a notice to postpone the graduation ceremony for students, on November 2, 2024 at Muong Thanh Hotel - Bac Ninh City, Mr. Pham Ngoc Truc (appointed by Ms. Nguyen Thi Tuyet Hong as Vice Principal of Kinh Bac University in violation of regulations and legal procedures) organized the graduation ceremony and awarded certificates to 160 graduating students.

The school explained: "The Chairman of the Board of Directors of Kinh Bac University is Mr. Doan Xuan Tiep and the Principal of Kinh Bac University is Mr. Nguyen Van Hoa.   The fact that Ms. Nguyen Thi Tuyet Hong used her position as Chairwoman of the Board of Directors of Kinh Bac University to appoint and assign tasks to Mr. Pham Ngoc Truc and Ms. Dao Thi Bich Thuy was not within her authority, not in accordance with procedures, and not in accordance with the provisions of law. Therefore, Mr. Pham Ngoc Truc and Ms. Dao Thi Bich Thuy are not Vice Principals of Kinh Bac University. The act of Mr. Pham Ngoc Truc and Ms. Dao Thi Bich Thuy claiming to be Vice Principals is an illegal act.

The authority to sign and issue university graduation certificates is the Principal. Kinh Bac University currently has Associate Professor, Dr. Nguyen Van Hoa as its Principal. Mr. Pham Ngoc Truc is not a legal Vice Principal, so the act of Mr. Pham Ngoc Truc signing and issuing graduation certificates to students is illegal and has no legal value, leading to the entire certificate signed and issued by Mr. Pham Ngoc Truc to students being illegal.

Mr. Pham Ngoc Truc's signing and granting of degrees has affected the legitimate interests of students, Kinh Bac University and society.

Kinh Bac University affirms that all 160 university graduation diplomas signed and issued to students of the second batch of 2024 by Mr. Pham Ngoc Truc are not in accordance with the law, these are illegal diplomas. Kinh Bac University recommends that employers and students who have received the above graduation diplomas avoid risks and bad legal consequences that will occur due to the signer, issuer not having the right authority and taking advantage of their position and power.

Previously, the Ministry of Education and Training received a petition from Ms. Nguyen Thi Tuyet Hong, Mr. Doan Xuan Tiep and related individuals and organizations reflecting and recommending on the organization and operation of Kinh Bac University.

In carrying out its responsibility for state management ofeducation , the Ministry of Education and Training has worked with relevant parties to verify information about the organization and operation of Kinh Bac University. Based on the reports and supporting documents provided by relevant parties up to October 16, 2024, the Ministry has made a number of comments:

The dismissal of Mr. Doan Xuan Tiep as Chairman of the University Council, the dismissal of Ms. Nguyen Thi Tuyet Hong as Vice Chairman of the University Council, the recognition of Ms. Nguyen Thi Tuyet Hong as Chairman of the University Council, and the addition and replacement of other members of the University Council of Kinh Bac University from December 2023 to present have not been carried out in accordance with the procedures prescribed in Article 8 of Decree No. 99/2019/ND-CP dated December 30, 2019 of the Government, detailing and guiding the implementation of a number of articles of the Law amending and supplementing a number of articles of the Law on Higher Education and the Regulations on organization and operation of Kinh Bac University issued together with Decision No. 03/QD-HDT dated August 15, 2020 of the University Council of Kinh Bac University.

The dismissal of Mr. Nguyen Van Hoa from the position of President of Kinh Bac University and the assignment of Ms. Dao Thi Bich Thuy to be in charge of and manage all activities of Kinh Bac University did not comply with the procedures prescribed in Article 16a of the Law on Higher Education 2012 (amended and supplemented in 2018), Clause 5, Article 8 of Decree No. 99/2019/ND-CP and the Regulations on organization and operation of Kinh Bac University issued together with Decision No. 03/QD-HDT dated August 15, 2020 of the Council of Kinh Bac University.

The fact that Kinh Bac University does not comply with the provisions of law on organization and operation is the responsibility of the investors and the Council of Kinh Bac University. Therefore, the Ministry of Education and Training requests that the investors and the Council of Kinh Bac University urgently take measures to stabilize the organization and operation, and complete the organizational structure and personnel in accordance with the provisions of law.

The Ministry of Education and Training requests Kinh Bac University to report in writing with evidence on the implementation of the above contents and send it to the Ministry before November 15, 2024.
