Social housing buyers

The Department of Construction provides specific regulations on subjects registering to buy social housing (subjects registering to buy social housing according to the provisions of Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, Article 76 of the Housing Law): People with meritorious services to the revolution, relatives of martyrs who are eligible for housing improvement support according to the provisions of the Ordinance on Incentives for People with Meritorious Services to the Revolution; poor and near-poor households in rural areas; poor and near-poor households in rural areas in areas frequently affected by natural disasters and climate change; poor and near-poor households in urban areas; low-income people in urban areas; workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks; officers, professional soldiers, non-commissioned officers of the people's armed forces, police workers, civil servants, defense workers and officials currently serving in the army; Cryptographers, other workers in cryptographic organizations receiving salaries from the State budget currently working.

Cadres, civil servants and public employees as prescribed by law on cadres, civil servants and public employees; subjects who have returned public housing as prescribed.

Households and individuals whose land is recovered and whose houses must be cleared and demolished according to the provisions of law but have not yet received compensation from the State in the form of houses and residential land.

Regulations on conditions for registration to buy social housing (subjects specified in Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, Article 76 of the Housing Law) must meet the conditions of not having a house of their own in Da Nang city, not having purchased or rented a social house, not having enjoyed housing support policies in any form in Da Nang city or having a house of their own in Da Nang city but the average housing area per capita is lower than 15m2 of floor/person.

The case of not having a house of one's own is determined when the applicant and spouse (if any) are not named in the Certificate of land use rights and ownership of assets attached to land in Da Nang city at the time of submitting the application for social housing purchase.

In case the applicant owns a house but the average housing area per capita is less than 15 m2 of floor space/person. The average housing area per capita is determined based on the following: the applicant, his/her spouse, father, mother (if any) and children (if any) registered as permanent residents in that house.

Regarding income conditions (Subjects specified in Clauses 5, 6, 8, Article 76 of the Housing Law must ensure income conditions): In case the applicant is single, the actual monthly income received must not exceed 15,000,000 VND calculated according to the salary and wage table confirmed by the agency, unit, or enterprise where the applicant works.

In case the applicant is married according to the provisions of law, the applicant and his/her spouse must have a total monthly income of no more than VND 30,000,000 calculated according to the salary and wage table confirmed by the agency, unit, or enterprise where the applicant works.

Time to confirm income conditions within 1 consecutive year, calculated from the time of submitting valid documents to the investor to register to buy social housing. In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a labor contract: If single, the actual monthly income received shall not exceed 15,000,000 VND, if married according to the provisions of law, the applicant and his/her spouse shall have a total actual monthly income received not exceeding 30,000,000 VND.

The People's Committee of the commune/ward level shall confirm the income conditions for one consecutive year, calculated from the time of submitting valid documents to the investor to register to buy social housing. The subjects specified in Clauses 2, 3, 4, Article 76 of the Housing Law must be poor or near-poor households according to the Government 's poverty standards.

The subjects specified in Clause 7, Article 76 of the Housing Law must ensure the following income conditions: In case the applicant is single, the actual monthly income received must not exceed the total income of an officer with the rank of Colonel (including basic salary and allowances according to regulations) confirmed by the agency or unit where he/she works and manages.

In case the applicant is married according to the provisions of law: The applicant and his/her spouse are both subjects specified in Clause 7, Article 76 of the Housing Law, the total monthly income actually received is not more than 2.0 times the total income of an officer with the rank of Colonel (including basic salary and allowances according to regulations) confirmed by the agency or unit where he/she works or manages; the applicant's spouse is not subject to the provisions of Clause 7, Article 76 of the Housing Law, the total monthly income actually received is not more than 1.5 times the total income of an officer with the rank of Colonel (including basic salary and allowances according to regulations) confirmed by the agency, unit or enterprise where he/she works.

In case the applicant’s spouse does not have a labor contract, the People’s Committee at the commune level will confirm the income condition. The time for confirming the income condition is within 1 consecutive year, calculated from the time of submitting a valid application to the investor to register to buy social housing.

Proof of income

Subjects specified in Clauses 2, 3, 4, Article 76 of the Housing Law shall provide a certified copy of the certificate of poor or near-poor household. The form of documents proving income conditions shall comply with Form No. 04 - Circular No. 05/2024/TT-BXD for subjects specified in Clauses 5, 6, 7, 8, Article 76 of the Housing Law or Form No. 05 - Circular No. 05/2024/TT-BXD for subjects specified in Clause 5, Article 76 of the Housing Law but without a labor contract.

Agencies, units, and enterprises where the following subjects are working shall carry out confirmation according to Form No. 04 - Circular No. 05/2024/TT-BXD for subjects specified in Clause 5, Article 76 of the Housing Law (in case of having a labor contract) and Clauses 6, 7, 8, Article 76 of the Housing Law. In case the subjects are on leave (retired), the document proving the income condition is the decision to retire and receive the pension of that person.

The People's Committee of the commune where the declarant registers permanent/temporary residence shall make confirmation according to Form No. 05 - Circular No. 05/2024/TT-BXD for subjects specified in Clause 5, Article 76 of the Housing Law but without a labor contract. In case the applicant for social housing registration is married, he/she must declare the form of documents proving income conditions according to Form No. 04 or Form No. 05 for husband and wife.

Procedures; approval of social housing purchase and sale documents

Based on the announced information on social housing projects, households and individuals in need submit their application to purchase social housing directly to the project investor. When the applicant submits the application, the person receiving the application must issue a receipt. If the application is not valid (not in accordance with regulations), the person receiving the application is responsible for clearly stating the reason for not being resolved and returning it to the applicant for supplementation and completion.

After collecting all registration documents of the interested subjects, the investor of the social housing construction investment project is responsible for reviewing each application, registration, and comparing it with the regulations on subjects and conditions according to the regulations to make a list of subjects eligible to buy social housing of the project.

The investor of the social housing construction investment project is responsible for sending the list of subjects expected to be eligible to buy social housing in order of priority to the Department of Construction to organize an inspection to determine the correct subjects eligible to buy social housing and to exclude those who have registered to buy social housing in this project who have bought or rented social housing, and have received housing support from the state in any form in Da Nang city.

After signing the social housing purchase contract, the project investor is responsible for compiling a complete list of subjects (including household members) who have purchased social housing and sending it to the Department of Construction for public announcement within 30 days from the date of receipt of this list and storing it for management and inspection (post-inspection). At the same time, the project investor is responsible for publicly announcing this list at the investor's office and at the real estate trading floor or the investor's social housing information website (if any).

In principle, criteria for reviewing applications for social housing purchase:

In case the total number of valid registration applications is equal to or less than the total number of apartments announced for sale, the selection of apartments will be carried out according to the agreement between the investor and the customer.

In case the total number of valid registration applications is greater than the total number of apartments announced for sale, the review and selection of subjects will be carried out by drawing lots (directly or online) organized by the investor, with the participation of a representative of the Department of Construction to supervise. The drawing must have a record of the drawing results.

In case the project has priority subjects as prescribed in Point d, Clause 1, Article 79 of the Housing Law, they will be given priority to buy social housing without having to draw lots at a certain rate. The number of apartments for these priority subjects (without drawing lots) is determined by the ratio between the total number of applications of these 5 priority groups and the total number of registered applications multiplied by the total number of social housing apartments of the project.

The list of priority groups is arranged in order according to the time of application submission. Apartments for priority groups are arranged in order of priority list until exhausted, the remaining groups continue to participate in the lottery (organized by the investor, with representatives of the Department of Construction and related units participating in supervision).

Time and place for receiving applications for social housing purchase

Households and individuals wishing to register to buy social housing should contact the investor directly for instructions and submit an application to buy social housing:

Application guidance period from May 28 to July 22, 2025.

Time for receiving documents from June 30 to July 22, 2025. (From Monday to Saturday morning (except Sundays and holidays), morning from 8:15 to 11:45; afternoon from 13:45 to 17:00.
