Must convert medical practice certificate to practice license

According to the Government's electronic information portal, from January 1, 2024, Law No. 15/2023/QH15 on medical examination and treatment of the National Assembly will take effect, which includes transitional provisions on converting practice certificates to practice licenses.

1. Practice certificates issued before January 1, 2024 shall be converted to practice licenses according to the roadmap prescribed by the Government and shall be renewed periodically every 5 years from the date of conversion according to the provisions of this Law.

2. The issuance of practice certificates for applications submitted before January 1, 2024 shall be carried out in accordance with the provisions of the Law on Medical Examination and Treatment No. 40/2009/QH12, which has been amended and supplemented by a number of articles under Law No. 21/2017/QH14.

3. The practice certificate issued under the provisions of (2) above must be converted into a practice license and renewed under the provisions of (1) above.

4. Regulations on the use of language in licensing and practicing medical examination and treatment for foreigners and Vietnamese people residing abroad as prescribed in the Law on Medical Examination and Treatment No. 40/2009/QH12, which has been amended and supplemented by a number of articles under Law No. 21/2017/QH14, shall be applied until December 31, 2031.

5. The suspension and revocation of practice certificates granted under the provisions of the Law on Medical Examination and Treatment No. 40/2009/QH12, which has been amended and supplemented by a number of articles under Law No. 21/2017/QH14, shall be carried out in accordance with the provisions on suspension and revocation of practice licenses in this Law.

6. Applicants for a license to practice as a doctor from January 1, 2024 to December 31, 2026 are not required to take a professional capacity assessment test as prescribed by this Law.

7. Applicants for a license to practice as a physician, nurse, or midwife from January 1, 2024 to December 31, 2027 are not required to undergo a competency assessment test as prescribed by this Law.

8. Applicants for a license to practice as a medical technician, clinical nutritionist, outpatient emergency worker, or clinical psychologist from January 1, 2024 to December 31, 2028 are not required to undergo a competency assessment test as prescribed by this Law.

9. A person licensed to practice as prescribed in 1, 2, 6, 7 and 8 above must comply with the regulations related to practice as prescribed in this Law.

10. People who are granted a diploma of intermediate medical training after December 31, 2026 will not be granted a practice license for the title of medical doctor.

According to Article 26, Law 15/2023/QH15 on medical examination and treatment, professional titles that must have a practice license include:
a) Doctor;
b) Physician;
c) Nursing;
d) Midwifery;
d) Medical engineering;
e) Clinical nutrition;
g) Outpatient emergency personnel;
h) Clinical psychology;
i) Physician;
k) People with traditional medicine or traditional treatment methods.
