According to Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government , regulating the decentralization of authority of local authorities at two levels, decentralization, and decentralization in the field of land, currently, the settlement of procedures for granting land use right certificates for the first time will be carried out at the commune level. The Chairman of the People's Committee at the commune level is assigned the authority to grant land use right certificates and assets attached to land for the first time to domestic individuals, overseas Vietnamese with Vietnamese nationality and residential communities in cases that meet the prescribed conditions.
Mr. Nguyen Xuan Hien, Deputy Director of the Public Service Center of Quang Ninh Commune, said: “The assignment of authority to the Chairman of the People's Committee at the commune level to issue the Land Use Right Certificate for the first time is a step forward in reforming administrative procedures. People only need to go to the Public Service Center of the commune or ward to submit their application. The Public Service Center will directly appraise the application and transfer it to the specialized department. Professional staff will handle the necessary procedures and submit it to the Chairman of the People's Committee at the commune level to sign and issue the Land Use Right Certificate. Therefore, it will shorten the time and save the effort of traveling for people.”
Coming to the Public Security Center of Dong Son ward to complete the procedures for dividing the plot and transferring land use rights to her child, Ms. Nguyen Thi Thuan, residential group 5, Dong Son ward, was happy because all the procedures and documents were completed quickly.
Ms. Thuan shared: “Previously, when it came to procedures related to granting land use right certificates, we were very hesitant because we had to go through many steps. People had to submit their applications at the ward’s one-stop department to carry out the confirmation procedures, then go to the city’s one-stop reception and results department to submit their applications, so the waiting time was longer and took more effort. Now the process has been shortened, only carried out at a single level, the commune and ward. This not only helps reduce time and costs, but also creates maximum convenience for people when carrying out land procedures.”
According to current regulations, the procedure for registering land, assets attached to land, and issuing certificates of land use rights and ownership of assets attached to land for the first time at the commune level will include three steps. Step one, the applicant comes to register and submit the application at the PVHCC Center. Step two, the center receives the application, checks the completeness of the application components, issues a receipt of the application and makes an appointment to return the results. In case the application components are not complete, it will be returned with a request form for additional information and completion of the application so that the applicant can complete and supplement it according to regulations. Step three, the People's Committee of the commune where the land is located will inspect the actual land use of the organization or individual and determine the specific boundaries of the land plot. Then, the Chairman of the People's Committee of the commune will issue the certificate of land use rights and ownership of assets attached to land after receiving a notice from the tax authority on the completion of financial obligations.
The time for carrying out procedures for land registration and property attached to land according to the new regulations is no more than 17 working days; for land registration with issuance of land use right certificates, it is no more than 20 working days. Particularly in mountainous areas, islands, remote areas or areas with particularly difficult socio -economic conditions, the processing time may be extended to a maximum of 30 working days.
Present at the PVHCC Center of Quang Ninh commune, we noticed that there were many people coming to do the procedures for granting land use right certificates. The officials and civil servants in charge of the land sector guided and explained in great detail so that people could understand the necessary documents and papers related to the first issuance of land use right certificates.
Ms. Le Thi Le Ha, an expert from the Economic Department, in charge of land in Quang Ninh commune, said: “The decentralization of authority to the Chairman of the People's Committee at the commune level to issue land use right certificates not only creates convenience for the people but also facilitates officials and civil servants in handling procedures related to the land sector, helping to issue land use right certificates more accurately. Because local officials will have a better understanding of the area, administrative boundaries, and know the location of land plots in their locality, verification will be very convenient.”
Land is a very complicated field, directly related to people and businesses, so mistakes often occur. Therefore, decentralizing the authority to the Chairman of the People's Committee at the commune level to sign the decision to grant land use right certificates also means that the responsibility of officials and civil servants in charge of the land field is also higher, requiring careful and accurate processing of documents, procedures, and information verification.
Accordingly, in order to serve the people effectively and accurately, the People's Committee at the commune level has directed the staff and civil servants to uphold their spirit and responsibility in handling administrative procedures in general and in the land sector in particular.
Mr. Doan Hong Quan, Chairman of Dong Son Ward People's Committee, Quang Tri Province said: "The team of leaders and civil servants of the ward need to demonstrate their responsibility for the work they are doing. They must be truly diligent, taking the spirit of serving the people as the top priority to solve the work, bringing convenience to the people under possible conditions. In addition, the Department of Agriculture and Environment also needs to deploy training courses on professional skills for the team of civil servants in charge of the land sector at the commune level."
The transfer of the authority to issue land use right certificates from the previous district-level People's Committee to the commune and ward-level People's Committees is an important step in the roadmap to build a serving government. It is also a concrete manifestation of the spirit of administrative reform, focusing on the grassroots level, bringing public agencies closer to the people and businesses, in order to bring convenience to the people.
