
Overcoming duplication and overlap in the activities of inspection agencies
Presenting the Draft Law, Government Inspector General Doan Hong Phong said that the draft Law was developed from the viewpoint of serving the process of arranging the inspection agency system in a centralized, unified, and streamlined direction at a single focal point at 2 levels at the central and local levels; overcoming the shortcomings, limitations, overlaps, and duplications in the organization and operation of current inspection agencies.
At the same time, specify the direction of the Politburo and the Secretariat on the mechanism of power control and working relationships of the inspection system at all levels; between the Government Inspectorate and ministries, branches and localities, between the Provincial Inspectorate and departments and branches when implementing the arrangement and streamlining of the inspection agency system.

Government Inspector General Doan Hong Phong said that the draft Law on Inspection (amended) consists of 9 chapters and 64 articles. In particular, it inherits the provisions of 30 articles in the current law on: scope of regulation, principles of operation, order and procedures for conducting an inspection, tasks and powers of the person making the inspection decision, Head of the inspection team, members of the inspection team... because these provisions of the Law on Inspection 2022 are not affected by the arrangement of the inspection agency system and are still suitable for practice.
The Draft Law also completely removes regulations on Ministry Inspectorate, General Department Inspectorate, Departments under the Ministry, inspection agencies in Government agencies, Department Inspectorate, District Inspectorate, organization and operation of agencies assigned to perform specialized inspection functions...
According to the Government Inspector General, the draft Law also amends and completes regulations on inspection agencies and perfects the concept of "inspection". In particular, Article 7 of the draft Law stipulates that inspection agencies include: Government Inspectorate; provincial and centrally-run city inspectorates; inspection agencies in the People's Army, People's Public Security, State Bank of Vietnam; Cryptographic Inspectorate; inspection agencies established under international treaties to which the Socialist Republic of Vietnam is a member; specific regulations on the Inspectorate of the Ministry of Public Security, the Inspectorate of the Ministry of National Defense, and the Inspectorate of the State Bank.
Presenting the Report on the review of the draft Law, Chairman of the Law and Justice Committee Hoang Thanh Tung agreed to comprehensively amend the 2022 Law on Inspection with the reasons, political, legal, practical bases, and viewpoints as stated in the Government's Submission.

The Chairman of the Law and Justice Committee also said that the Committee found that the draft Law stipulates the basic concept of inspection inheriting the current Law on Inspection (Clause 1, Article 2), but does not stipulate that "inspection activities include administrative inspection and specialized inspection", at the same time, in the specific articles and clauses of the draft Law, these two types of inspection activities are not mentioned.
Through discussion, some opinions suggested clarifying: in the tasks of the inspection agency after the reorganization, will the above two types of inspection activities continue to be maintained? If specialized inspection activities are no longer maintained, will they meet practical requirements? If specialized inspection activities are still maintained, is it appropriate and feasible to conduct these two types of inspection activities in the same order and procedure? Does the Government Inspectorate conduct specialized inspections?
“These are important issues that need to be clarified and unified in terms of awareness to serve as a basis for regulating the specific tasks and powers of inspection agencies as well as the order and procedures for conducting inspections,” the Chairman of the Law and Justice Committee suggested.
It is necessary to clearly define the tasks of the inspection agency after the arrangement.
Members of the National Assembly Standing Committee agreed that the draft Law basically adhered to the Party's guidelines and policies, especially Conclusion No. 134-KL/TW dated March 28, 2025 of the Politburo and the Secretariat on the Project to streamline the inspection agency system to be streamlined, strong, effective, efficient and effective. At the same time, it thoroughly implemented the innovation in law-making thinking to build a quality, concise draft Law with only 64 articles, a 54% reduction in the total number of articles compared to the current Law.

Basically agreeing with the main contents of the draft Law proposed by the Government, however, Chairman of the Committee for Science, Technology and Environment Le Quang Huy agrees with the proposal of some opinions in the Committee for Law and Justice; suggesting that the drafting agency needs to clarify in the tasks of the inspection agency after the arrangement whether it will continue to maintain the two types of administrative inspection and specialized inspection activities or not?
On the other hand, the Chairman of the Committee on Science, Technology and Environment noted that although the draft Law does not clearly stipulate whether these two types of inspection activities will remain after the arrangement of inspection agencies, specialized laws still stipulate that inspectors must have specialized knowledge in that field. In fact, the draft Law on Atomic Energy, which is expected to be submitted to the National Assembly for consideration at the upcoming Ninth Session, also stipulates the inspection of nuclear radiation safety.

In his concluding remarks on this content, Vice Chairman of the National Assembly Nguyen Khac Dinh highly appreciated the efforts, endeavors, and urgency of the Government and the Government Inspectorate in preparing the draft Law dossier to submit to the National Assembly Standing Committee and the National Assembly according to the set program. The Law and Justice Committee has also been very responsible, coordinating with the National Assembly agencies and the drafting agency to review the draft Law, ensuring quality, and promptly submitting it to the National Assembly Standing Committee for comments.
The Vice Chairman of the National Assembly suggested that the Government take into account the opinions of the agency in charge of the review and the opinions of the members of the National Assembly Standing Committee to continue to complete the draft Law dossier before entering the Ninth Session scheduled to open on May 5. The Law and Justice Committee will take into account the opinions and, based on the Government's new draft Law, complete the review report to submit to the National Assembly in accordance with regulations.
