The land area of over 72 hectares in Tan Cang quarter, Phuoc Tan ward is an area planned for forest plantation. However, many years ago, production factories and business establishments were illegally built by individuals in this area.

Resolutely handle violations

In March 2020, the Provincial People's Committee issued Inspection Conclusion No. 2804/KL-UBND pointing out many violations in land use and illegal construction in this area; along with that, directing competent authorities to urgently verify and clarify violations for handling according to regulations; requiring the completion of the relocation of facilities and enterprises out of this area in 2025.

At the end of May 2025, the Provincial Party Committee issued Conclusion No. 556-KL/TU on handling a number of land-related cases in the province, including an area of more than 72 hectares in Phuoc Tan ward.

Implementing the direction of the Provincial Party Committee, on June 4, 2025, Comrade Vo Tan Duc, Deputy Secretary of the Provincial Party Committee, Chairman of the Provincial People's Committee, signed and issued a document on the implementation of Conclusion No. 556 of the Provincial Party Committee. In particular, for the area of more than 72 hectares in Phuoc Tan Ward, the Provincial People's Committee requested competent agencies to inspect the implementation of administrative violations in land and construction, and apply remedial measures according to regulations to force the relocation of establishments and businesses operating illegally here.

Based on the instructions of the Provincial Party Committee and the Provincial People's Committee, at the end of July 2025, Phuoc Tan Ward reviewed existing enterprises and production and business establishments in this area. The review results showed that in this area, there were 48 establishments and enterprises building on 68 plots of land. Of these, by the end of June 2025, the People's Committee of Bien Hoa City (old) had issued 48 decisions on compulsory remediation of consequences in the land and construction sector, including 23 cases in the land sector and 25 cases in the construction sector. As of July 25, 2025, out of 48 establishments and enterprises, 2 cases had complied with the demolition of construction works, 2 cases had stopped operations.

“There are currently 44 establishments and enterprises operating in production; of these, the authorities have issued 46 enforcement decisions for 41 cases. There are 3 cases where enforcement decisions have not been issued,” said a representative of the People’s Committee of Phuoc Tan Ward.

Efforts to complete early relocation of facilities and businesses

From July 1, when implementing a two-level local government, the handling and relocation of facilities and businesses in an area of more than 72 hectares in Phuoc Tan ward was assigned to this locality for implementation.

On that basis, in mid-July, the Standing Committee of the Phuoc Tan Ward Party Committee issued Directive No. 01 on strengthening leadership and direction in land management and construction order in the area. In particular, for the area of more than 72 hectares, the Standing Committee of the Phuoc Tan Ward Party Committee requested the People's Committee of Phuoc Tan Ward to develop a specific plan to overcome the consequences of violations. The plan must clarify the progress, clearly assign responsibilities to each cadre, responsible unit, and specific task group; at the same time, review the legal status of each case, handling measures (enforcement, mobilization for self-dismantling, overcoming consequences...), budget estimates, security and order assurance plans, and completion time for each stage. From there, advise the Standing Committee of the Ward Party Committee to issue leadership policies and establish propaganda and mobilization working groups to create consensus in the process of handling violations.

According to the People's Committee of Phuoc Tan Ward, from July 18 to 25, 2025, the People's Committee of Phuoc Tan Ward coordinated with 3 mobilization teams organized by the Standing Committee of the Party Committee of Phuoc Tan Ward to inspect 33/44 cases of establishments and enterprises still operating in an area of more than 72 hectares to review, classify, and consolidate records to develop an enforcement plan. For the remaining 11 cases, the functional sector is continuing to inspect, consolidate, complete records, and develop a handling plan.

Phuoc Tan Ward Party Secretary Nguyen Phong An said: According to the request of the Provincial Party Committee and the Provincial People's Committee, the relocation of facilities and enterprises in the area of more than 72 hectares must be completed in December 2025. On that basis, Phuoc Tan Ward People's Committee has developed an implementation plan with a roadmap to complete the relocation of facilities and enterprises in this area in November 2025. However, with the goal of completing it sooner, the Ward Party Committee has requested the Ward People's Committee to rebuild the plan with the goal of shortening the time and completing the relocation of facilities and enterprises in October 2025.
