National Assembly 'finalizes' law stipulating that civil servants and public employees have only one nationality

On the morning of June 24, with 416/416 delegates present in favor, the National Assembly passed the Law amending and supplementing a number of articles of the Law on Vietnamese Nationality.

4 groups can only have one Vietnamese nationality

Notably, the new law amends and supplements a number of provisions on the relationship between the State and citizens.

Accordingly, in the territory of Vietnam, the State only recognizes Vietnamese nationality for Vietnamese citizens who also have foreign nationality in relations with competent authorities of Vietnam, except in cases where international treaties to which Vietnam is a member have other provisions.

The rights and obligations of Vietnamese citizens who also have foreign nationality and are residing abroad are implemented according to the provisions of relevant laws.

Candidates, elected, approved, appointed, designated to hold positions and titles for a term in agencies of the Party, State, Vietnam Fatherland Front, central and local socio -political organizations; people working in key organizations;

A person participating in the armed forces of Vietnam must have only one nationality, Vietnamese nationality, and must permanently reside in Vietnam.

Civil servants and public employees not covered by the above provisions must have only one nationality, Vietnamese nationality, except in cases where it is beneficial to the State, does not harm the national interests of Vietnam, and must reside permanently in Vietnam. The Government shall specify this clause in detail.

In a previous report, Minister of Justice Nguyen Hai Ninh said that at the discussion in groups and halls, many National Assembly deputies suggested carefully considering the exception regulations for all four groups of subjects, especially positions in the armed forces and elected and key agencies because these are positions that require absolute loyalty to the Fatherland, the State and the people, related to national security issues.

In response to comments, the Government has revised the regulation (in Clause 5, Article 5) in the direction of stipulating the principle that people must have only one nationality, Vietnamese nationality, and must permanently reside in Vietnam for 4 groups and only stipulate exceptions for the group of civil servants and public employees (except civil servants and public employees working in the armed forces) to attract cases with outstanding talents that are beneficial to Vietnam.

People applying for Vietnamese citizenship can choose a compound name.

The Law amends and supplements the conditions for naturalization in Vietnam: foreigners/stateless persons who meet the following conditions can be naturalized: full civil act capacity (except for minors naturalized under their parents who are Vietnamese citizens); comply with the Constitution and laws; respect Vietnamese culture; know Vietnamese; have permanent residence in Vietnam for 5 years or more; and have the ability to ensure their own livelihood.

A person applying for Vietnamese nationality whose spouse or biological child is a Vietnamese citizen can be granted Vietnamese nationality without having to meet the above conditions.

Along with that, the law stipulates that people applying for Vietnamese nationality must have a name in Vietnamese or in another ethnic language of Vietnam.

In case a person applying for Vietnamese nationality and at the same time applying to retain foreign nationality can choose a name combining Vietnamese and foreign names. The name is chosen by the person applying for Vietnamese nationality and is clearly stated in the decision to grant Vietnamese nationality.

Explaining this regulation, the Minister of Justice said that some National Assembly delegates suggested that there should not be a strict requirement that a name must be in Vietnamese, but that it could be a Vietnamized name or that the original name of the person applying for Vietnamese nationality could be used to ensure international integration.

In response to comments, the Government has revised the regulations in the direction that people applying for/returning to Vietnamese nationality while also applying to retain foreign nationality can choose a name that combines their Vietnamese name and foreign name to ensure convenience for them when living and working in the countries of which they have nationality.
