The National Assembly passed a Resolution on the vote of confidence and vote of no confidence.

The results showed that 470 delegates participated in the vote in favor (accounting for 95.14%). Thus, with the majority of delegates participating in the vote in favor, the National Assembly officially passed the Resolution on taking a vote of confidence, a vote of no confidence for people holding positions elected or approved by the National Assembly and People's Councils (amended).

Before the National Assembly deputies participated in the vote, the National Assembly listened to the report of the Standing Committee of the National Assembly, Chairman of the Law Committee Hoang Thanh Tung, explaining, accepting and revising the draft Resolution on taking a vote of confidence, voting for confidence in people holding positions elected or approved by the National Assembly or People's Council (amended).

Delegates vote to pass the Resolution

Mr. Hoang Thanh Tung presented and said that there was a proposal not to regulate the vote of confidence for commune-level officials. The Standing Committee of the National Assembly accepted and revised Clause 2, Article 2 of the draft Resolution in the direction that the vote of confidence can only be carried out at the People's Councils at the provincial and district levels.

Regarding the issue of not taking a vote of confidence for people with serious illnesses confirmed by a medical facility and not having worked for 6 months or more, after discussion, there were opinions in agreement with the draft Resolution and a proposal to add cases of having stopped working for 6 months or more for other reasons (not for health reasons). On the contrary, some opinions suggested that it is necessary to closely follow Regulation No. 96-QD/TW on cases where a vote of confidence is not taken to ensure strictness and avoid abuse.

The Standing Committee of the National Assembly finds that taking a vote of confidence is an important monitoring channel of the National Assembly and the People's Council; the results of the vote of confidence are used to evaluate cadres, serving as a basis for planning, mobilizing, appointing, recommending cadres for election, dismissing and implementing regimes and policies for cadres. Regulation No. 96-QD/TW has specifically identified cases where a vote of confidence is not taken. In response to the opinions of National Assembly deputies, the Standing Committee of the National Assembly has revised the regulation in Clause 5, Article 2 of the draft Resolution in the direction of not taking a vote of confidence for those who have announced their resignation pending retirement or have been appointed or elected in the year of taking a vote of confidence.

Regarding the process of taking a vote of confidence and voting for confidence at the National Assembly and People's Councils, some opinions suggested clarifying the cases where the Standing Committee of the National Assembly submits a vote of confidence to the National Assembly, and should not generally stipulate "when deemed necessary" as in Point a, Clause 1, Article 14. The Standing Committee of the National Assembly accepts the opinions of National Assembly deputies and revises the provisions at Point a, Clause 1, Article 14 to clarify the cases where the Standing Committee of the National Assembly proposes a vote of confidence to the National Assembly as shown in the draft Resolution.

Regarding the proposal to add a provision allowing the person who is voted for a vote of confidence to explain to the National Assembly or the People's Council after discussion at the National Assembly Delegation or the People's Council Delegation, the National Assembly Standing Committee accepts and adjusts the process of voting for confidence at the National Assembly or the People's Council in the draft Resolution to ensure consistency with the process of dismissal, removal, approval of proposals for dismissal, removal of people holding positions elected or approved by the National Assembly as prescribed in the Internal Rules of the National Assembly session.

Regarding the proposal to stipulate that if a person who is voted for a vote of confidence has more than half of the total votes of "no confidence", the National Assembly and the People's Council will consider dismissing him/her immediately at that session without waiting for the next session, the Standing Committee of the National Assembly said that the draft Resolution stipulates that the consideration of dismissal for a person who has more than half of the total votes of "no confidence" can be done at that session or the nearest session to ensure flexibility in implementing personnel procedures.

Such a provision is also consistent with the practical operation of the People's Council at the local level, when the People's Council's session usually only lasts for a very short time. On the other hand, Article 19 of the draft Resolution has added a provision on the responsibility to report the results of the vote of confidence and the vote of confidence of the People's Council to the competent authority in charge of cadre management and the direct superior agency for supervision, so issues related to cadre work will be closely monitored and handled as soon as possible, limiting the situation where cadres with low confidence continue to hold their positions for a long time afterwards.

In addition, the National Assembly Standing Committee also explained how to calculate the percentage of the vote of confidence (Article 19). The National Assembly Standing Committee would like to receive the opinions of the delegates and has reviewed and revised the relevant provisions on how to calculate the results of the vote of confidence in the draft Resolution (Articles 12, 13, 17 and 19). Accordingly, the total number of votes used as the basis for calculating the percentage of the vote of confidence is the total number of votes collected when National Assembly deputies and People's Council deputies conduct the vote of confidence and vote of confidence to ensure consistency with Regulation No. 96-QD/TW.

Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that, based on the opinions of National Assembly deputies, the draft Resolution submitted to the National Assembly for approval has been revised and perfected in both content and technical text, including 22 articles and 07 attached appendices.
