Clause 1, Article 13 of the 2013 Constitution stipulates: The national flag of the Socialist Republic of Vietnam is rectangular, with a width equal to two-thirds of its length, a red background, and a five-pointed yellow star in the middle. The Ministry of Culture, Sports and Tourism also has Instruction No. 3420/HD-BVHTTDL (hereinafter referred to as the Instruction) on the use of the National Flag, National Emblem, National Anthem, and portrait of President Ho Chi Minh. Clause 1, Article 1 of the Instruction stipulates the image of the National Flag: Image of the National Flag: Article 141, Chapter XI of the 1992 Constitution of the Socialist Republic of Vietnam; Circular No. 68/VHTT-TT dated August 24, 1993 of the Ministry of Culture and Information (now the Ministry of Culture, Sports and Tourism). “…The national flag of the Socialist Republic of Vietnam is rectangular, the width is two-thirds of the length, the background is red, in the middle is a five-pointed yellow star…” - The middle point of the yellow star is placed exactly at the midpoint (the intersection point of the two diagonals) of the national flag. - The distance from the middle point of the star to the tip of the star wing is one-fifth of the length of the national flag. - One wing of the star has an axis perpendicular to the long edge of the national flag and points straight up along the top of the flagpole. - The shape of the star: from the tip of one wing of the star to the tip of the opposite wing of the star is a straight line, not bulging in the middle, the wing of the star is not curved. - Both sides of the national flag have a yellow star that overlaps each other. - The background of the national flag is bright red, the star is bright yellow
The method of hanging and the time of hanging the National Flag are specified in Clause 2, Article 1 of the Guidelines. Regarding the method of hanging the National Flag: - When hanging the National Flag, be careful not to place the star upside down. - When hanging a photo or portrait of a leader with the National Flag, the photo must be lower than the National Flag or placed on the National Flag background under the star . Regarding the time of hanging the National Flag: - The National Flag is hung in meeting rooms, halls of all levels of government, state agencies and organizations when holding solemn meetings. - The National Flag is hung outdoors on major holidays, political events, traditional New Year of the nation and according to the announcement of the Central and local authorities. - The National Flag is hung or carried in places where rallies, parades, mass mobilization, production emulation campaigns, and revolutionary movements are held. - State agencies, schools (including academies), armed forces, border gates, international ports must have flagpoles and hang the National Flag in front of the office, or in a solemn place in front of the office door. The National Flag must meet the standards of size and color as prescribed by the Constitution. - The Presidential Palace, the National Assembly, the Ho Chi Minh Mausoleum, the Government headquarters, the Supreme People's Court, the Supreme People's Procuracy, the Ministry of Foreign Affairs, Vietnamese embassies in other countries, the Hanoi Flagpole, the headquarters of People's Committees at all levels (except for People's Committees of wards in cities and towns), border gates and international ports must hang the National Flag 24/7 every day. - The headquarters of ministries, ministerial-level agencies, armed forces, and schools must hang the National Flag from 6:00 a.m. to 6:00 p.m. every day. - All the above agencies and units, especially foreign agencies, when receiving foreign guests from the Ministerial level or higher on official visits, must hang the guest's national flag along with the National Flag... Those who insult the Vietnamese National Flag may be punished. Article 351 of the Penal Code 100/2015/QH13 stipulates "Crime of insulting the National Flag, National Emblem, National Anthem": Anyone who intentionally insults the National Flag, National Emblem, or National Anthem shall be subject to a warning, non-custodial reform for up to 3 years, or imprisonment from 6 months to 3 years.
