Decree No. 92/2024/ND-CP clearly states that the business registration agency for cooperative groups, cooperatives, and cooperative unions is the Finance - Planning Department under the People's Committee of districts, towns, cities under provinces, and cities under centrally-run cities (District-level People's Committee).
For provinces and centrally run cities that pilot specific mechanisms and policies according to the National Assembly 's resolution, the business registration agency of cooperative groups, cooperatives, and cooperative unions shall implement the decision of the competent authority as prescribed by law.
The above business registration agencies are district-level business registration agencies.
Duties and powers of district-level business registration agencies
The district-level business registration agency is responsible for directly receiving registration dossiers for cooperative groups, cooperatives, and cooperative unions; reviewing the validity of the dossiers and granting or refusing to grant registration for cooperative groups, cooperatives, and cooperative unions; providing guidance to cooperative groups, cooperatives, and cooperative unions and the founders of cooperative groups, cooperatives, and cooperative unions on dossiers, procedures, and registration procedures.
District-level business registration agencies coordinate in building, managing and operating the Cooperative Registration Information System; digitizing records, standardizing, converting data, updating and supplementing registration information of cooperative groups, cooperatives and cooperative unions in the locality to the Cooperative Registration Database.
Provide information on cooperative registration, cooperative registration, and cooperative union registration stored in the Cooperative Registration Database within the local management scope to the District People's Committee, the Business Registration Office under the Department of Planning and Investment of the province or centrally-run city and at the request of the anti-money laundering agency under the State Bank of Vietnam and relevant agencies as prescribed by law.
The district-level business registration authority shall directly inspect or request competent state agencies to inspect cooperative groups, cooperatives, and cooperative unions according to the contents of the registration dossier.
Request cooperative groups, cooperatives, and cooperative unions to report on their compliance with the provisions of the Law on Cooperatives and this Decree; request cooperative groups, cooperatives, and cooperative unions to temporarily suspend or terminate business in conditional investment and business lines, conditional market access lines for foreign investors upon receiving documents from competent state agencies stating that cooperative groups, cooperatives, and cooperative unions do not meet the prescribed conditions.
The district-level business registration agency has the responsibility to revoke and restore the Certificate of registration of cooperative groups, Certificate of registration of cooperatives, Certificate of registration of branch and representative office activities of cooperatives and cooperative unions; dissolve and terminate the operation of cooperative groups, cooperatives, cooperative unions, branches, representative offices, and business locations of cooperatives and cooperative unions according to the provisions of law...
The Ministry of Planning and Investment is responsible for inspecting, examining, and supervising district-level business registration agencies in performing the registration of cooperative groups, cooperatives, and cooperative unions.
