Accordingly, for the administrative procedures for land registration, property attached to land, issuance of land use right certificates, ownership of property attached to land (abbreviated as certificates - GCN) for the first time for individuals, residential communities, households, people of Vietnamese origin residing abroad, under the management scope of the People's Committee at the commune level, there are 4 procedures for 4 cases including: First registration of land, property attached to land; first registration of land, property attached to land for communes in mountainous areas, islands, remote areas, areas with difficult or especially difficult socio-economic conditions; first registration of land, property attached to land, issuance of GCN; first registration of land, property attached to land, issuance of GCN for communes in mountainous areas, islands, remote areas, areas with difficult or especially difficult socio-economic conditions.
Regarding the process of land registration, property attached to land, and first-time issuance of Certificates of Land Use Rights for individuals, communities, households, and people of Vietnamese origin residing abroad - in the case of land registration, property attached to land, and first-time issuance of Certificates of Land Use Rights, the People's Committee at the commune level shall follow a 9-step process (processing time 20 working days), as follows:
Step 1: Civil servants and public employees at the Commune-level Public Administration Service Center provide guidance on receiving documents.
Step 2: The department leader and specialized civil servants at the commune-level People's Committee assign, appraise and verify the dossier; extract the cadastral map for places where there is a cadastral map. For places where there is no cadastral map and the registration and issuance of the Certificate of Land Use Rights already has a cadastral map excerpt, check and sign to confirm the cadastral map excerpt according to regulations. In cases where the registration and issuance of the Certificate of Land Use Rights does not have a cadastral map excerpt, the surveying unit is requested to conduct the cadastral map excerpt; the surveying unit is responsible for conducting the cadastral map excerpt within no more than 5 working days from the date of receipt of the request. Confirm the current status of land use with or without houses and construction works; the status of land disputes, assets attached to land, and stable land use; in cases where there are no documents on land use rights, confirm the origin of land use.
Check the conformity with planning for cases requiring conformity with planning to issue a Certificate of Land Use Right. Publicly post the results of the inspection and review at the headquarters of the People's Committee of the commune or residential area where the land and assets attached to the land are located for 15 days, and at the same time consider and resolve comments on the published content (if any). Step 4: The office at the commune-level People's Committee issues an information transfer form to determine financial obligations regarding land or a notice confirming that the land registration result is not qualified and returns the result.
Step 5: Tax authority leaders and officials determine and issue notices of financial obligations on land.
Step 6: One-stop staff of the Commune-level Public Administration Service Center; tax officer: stop calculating time, receive completion of financial obligations of land users.
Step 7: Department leaders and specialized civil servants of the Commune People's Committee synthesize and submit documents; draft GCN.
Step 8: The leader and secretary of the Commune People's Committee sign and approve the Certificate, issue and transfer the file with a copy of the issued certificate to the Branch of the Land Registration Office to establish, update and correct cadastral records and land database.
Step 9: Civil servants and public employees at the Commune-level Public Administration Service Center return the GCN results.
Along with the above-mentioned administrative procedures, the internal process for handling administrative procedures in the land sector under the management scope of the People's Committee at the commune level also includes 11 other administrative procedures such as: Redetermination of residential land area of households and individuals who were granted land use certificates before July 1, 2004; changing the form of land allocation and land lease; using land for multiple purposes...
