After nearly a day of trial, on the afternoon of March 7, the People's Procuracy of Binh Thuan province presented its opinion on the indictment of defendant Pham Van Nam (44 years old, from Ninh Binh province) for hitting and killing someone in Phan Thiet city. The prosecutor requested the panel of judges to sentence defendant Nam to 3-4 years in prison for murder.
The defendants Nguyen Thien Khiem, Tran Quoc Phong and Vo Lam Truong (all residing in Binh Thuan province) were proposed to be sentenced to 6-9 months in prison for the crime of intentionally damaging property. As for the crime of intentionally causing injury of the 3 defendants Khiem, Phong and Truong, at court, defendant Pham Van Nam did not request to be handled and was accepted and considered by the panel of judges.
According to the representative of the People's Procuracy, the investigation and interrogation at the trial determined that the defendant Pham Van Nam's wrongdoing was especially serious, illegally depriving another person of his life.

However, the representative of the People's Procuracy said that during the investigation, the defendant Nam compensated for the damage, committed the crime in a case of mental agitation caused by the illegal act of the victim, confessed honestly, after committing the crime, he surrendered and the victim's representative dropped the complaint, had a good personal history, so mitigating circumstances should be applied according to the provisions of the law.
According to the indictment, at around midnight on May 12, Pham Van Nam drove a Mercedes car with two friends to go drinking. When reaching the embankment area in front of Dieu Phat restaurant, Nam's car almost collided with Ha Xuan Hai's group (43 years old, residing in Phan Thiet City). Seeing that the incident was not serious, Nam continued driving to Thuan Phat restaurant about 100 meters away.
When the car stopped in front of the restaurant, Ha Xuan Hai used his hands, feet, and helmet to beat the defendant Nam and Nguyen Van Xuyen (41 years old, who was also sitting in the Mercedes).
After being beaten, Nam drove his car and crashed into his opponent's motorbike and chased Hai's group. Seeing this, Hai's group threw bottles, tables and chairs at the Mercedes. That day, Nam drove his car into Ha Xuan Hai when he threw a stainless steel table on top of the car. The victim died on the way to the hospital.
After committing the crime, Nam drove back to Ho Chi Minh City. On the afternoon of May 12, the suspect turned himself in and handed over the Mercedes.
According to the prosecution agency, after the Binh Thuan Provincial Police Department prosecuted the defendant Nam for murder, this defendant and Mr. Xuyen were assessed for disability with results of 1.5% and 4% respectively, and the Mercedes car suffered damage of more than 36 million VND. The Investigation Police Department returned the Mercedes car to the owner after the damage assessment results were available.
Nguyen Thien Khiem (34 years old), Vo Lam Truong (19 years old) and Tran Quoc Phong (28 years old, all residing in Binh Thuan province) were prosecuted for two crimes of intentionally causing injury and intentionally damaging property. Of which, defendants Nguyen Thien Khiem and Vo Lam Truong were released on bail, while Phong is serving a 6-month prison sentence in another case.
According to the indictment, after the incident, the defendant Nam’s family compensated the victim’s family with 500 million VND for funeral expenses and other damages. On August 15, 2022, the victim Hai’s wife and some related people filed a petition to drop the complaint against Pham Van Nam.
The People's Procuracy believes that the defendant Nam compensated for the damage, committed the crime in a state of mental agitation caused by the victim's illegal act; after committing the crime, he surrendered and confessed honestly; the victim's representative withdrew the complaint; and had a good personal history, so mitigating circumstances should be applied.
On the afternoon of March 9, the court announced the verdict.
