Increase the effectiveness of mineral resource management

The Government's recent issuance of Decree No. 193/2025/ND-CP dated July 2, 2025 not only aims to specify the Law on Geology and Minerals 2024 but also creates a favorable legal corridor to remove obstacles in licensing, auctioning, output control and environmental protection.

Thereby, contributing to improving the effectiveness and efficiency of state management in the field of geology and minerals, towards rational exploitation, effective use and sustainable development of national resources.

Make licensing and auction processes transparent

Decree No. 193/2025/ND-CP consists of 11 chapters and 155 articles, aiming to specify the Law on Geology and Minerals passed by the National Assembly on November 29, 2024. This is a strategic legal document, elaborately developed in the spirit of administrative reform, strengthening decentralization, delegation of authority and application of digital technology in resource management.

According to comrade Tran Binh Trong, Director of the Department of Geology and Minerals of Vietnam, Ministry of Agriculture and Environment , one of the highlights of the decree is to fundamentally resolve the long-standing bottlenecks in the licensing and auctioning of mineral exploitation rights. Instead of concentrating power at the central level, the decree strongly decentralizes to localities, giving them the right to proactively license the exploitation of most types of minerals, except for large-scale Group I minerals. The central ministries and branches only assume the role of guiding, planning and licensing at the strategic level.

This not only reduces the workload for ministries and branches, but also creates conditions for local authorities to be proactive in planning, attracting investment, exploiting and monitoring resources according to the characteristics of each region and locality. The spirit of "serving government" is clearly demonstrated, contributing to bringing policies into life more quickly and flexibly.

At the same time, the mineral exploitation rights auction process has been redesigned to be transparent, accessible, and prevent loss of national resources. All records and documents related to the auction area, investor capacity, winning bid results, etc. are included in the geological data system, publicly available on the national information portal. There are various forms of submission, including paper copies, postal mail, and electronic copies via online public services, helping businesses save time and costs, while reducing the chance of negative incidents during the appraisal and licensing process.

Production control and environmental protection

Decree No. 193/2025/ND-CP has also clearly and substantially resolved the financial mechanism and output control in an area that has caused many difficulties in mineral activities. Accordingly, the decree specifically stipulates the collection level of mining right fees, fees for using geological data information, and sanctions for recovery if mining does not meet the committed output... At the same time, it allows increasing the mining capacity (without increasing reserves) for Group IV minerals to meet the demand for raw materials for key national projects and urgent public investment projects.

Many experts believe that this is an important step forward, resolving the contradiction between the progress of major projects and the limitations of the previous rigid licensing framework. Thereby, ensuring the progress of essential projects while maintaining the principle of strict management of resource reserves. In particular, for the first time, the decree requires all equipment and means serving mineral exploitation to be inspected for safety and suitability to geological conditions before operation, especially in underground mining. This regulation helps reduce the risk of occupational accidents and improve safety standards throughout the industry.

In the field of environmental protection, the decree has many pioneering provisions approaching the circular economic model: Requiring reimbursement of mineral potential assessment costs after exploitation; clearly defining the responsibility of enterprises for environmental improvement and restoration; encouraging the reuse and recycling of waste in the mineral processing process.

Synchronize policies, promote sustainable exploitation

Not only a law enforcement document, Decree No. 193/2025/ND-CP is also a tool to institutionalize a series of important resolutions of the Party and State, including Resolution No. 10-NQ/TW dated February 10, 2022 of the Politburo on strategic orientations for geology, minerals and mining industry to 2030, with a vision to 2045; Resolution No. 39-NQ/TW dated January 15, 2019 of the Politburo on improving the efficiency of management, exploitation, use and promotion of economic resources.

The consistent point throughout the decree is to affirm that mineral resources are public assets owned by the entire people, managed by the State. Therefore, the regulations all aim at transparent, fair, sustainable management, and responsibility to the environment and the community.

Comrade Mai The Toan, Deputy Director of the Department of Geology and Minerals of Vietnam, said that Decree No. 193/2025/ND-CP is the result of a multi-level, multi-sector consultation process with the extensive participation of businesses, associations, and international experts. Thanks to that, the content of the decree is both legally compliant and practical and feasible in the current situation of the geology and mineral sector.

In reality, an effective legal document is not only reflected in the completeness of legislative techniques but also in the ability to handle practical issues that arise. In Decree No. 193/2025/ND-CP, this is clearly shown: From shortening the licensing time, promoting public auctions, transparently controlling output to creating a legal corridor for clean mining projects, technological innovation and environmental friendliness.

It can be affirmed that with this new legal corridor, it is expected that more businesses will boldly invest and apply advanced technology in mineral exploitation and processing; at the same time, opening up a more sustainable, modern and effective development period for the geology and mineral industry of our country.
