Continuing the agenda of the 9th Session, on May 15th, the National Assembly held a plenary session in the assembly hall to hear the presentation and the verification report on the draft Resolution of the National Assembly on some special mechanisms and policies to create breakthroughs in the development and organization of law enforcement.
Minister of Justice Nguyen Hai Ninh affirmed that the drafting of the Resolution is necessary to promptly institutionalize the Party's guidelines and policies on building a rule-of-law state and reforming the work of lawmaking.
At the same time, in order to overcome shortcomings, existing problems, and limitations in the work of drafting and organizing the implementation of laws; to develop some special mechanisms and policies on finance; to ensure and improve the quality of human resources; and to build and develop the application of digital technology and digital transformation in lawmaking and the organization of law enforcement.
This will create a breakthrough, strategic, timely, and flexible innovation, meeting the requirements of lawmaking and law enforcement, and fulfilling the demands of national development in the new era.
Minister of Justice Nguyen Hai Ninh stated that the draft Resolution is structured into 12 articles with a scope of regulation stipulating a number of special mechanisms and policies on finance, human resources, development and application of digital technology, and digital transformation to create breakthroughs in lawmaking, as well as a number of tasks and activities for organizing the implementation of laws that directly support lawmaking.
Regarding the special financial mechanism for lawmaking, the draft Resolution stipulates that the state budget shall ensure that expenditure on lawmaking is not less than 0.5% of the total annual state budget expenditure and shall gradually increase according to development requirements. The budget shall not only ensure expenditure for the drafting and promulgation of the system of legal documents and participation in international lawmaking, but also for other areas...
The draft Resolution stipulates the mechanism for implementing lump-sum payments, remuneration, and outsourcing for each task or activity in lawmaking; linking it to the autonomy and responsibility of the head of the agency performing the task or activity, based on compliance with the principles of applying special mechanisms and policies, and the regulations on exceeding expenditure limits stipulated in the Resolution and according to Government regulations (at least 3 to 5 times higher than the current limits); ensuring open, transparent, efficient, economical management, and preventing corruption, waste, and negative practices in the implementation of special mechanisms and policies stipulated in the Resolution.
The draft Resolution stipulates that the Fund for Supporting the Development of Policies and Laws is a non-budgetary state financial fund, with its charter capital guaranteed by the state from the state budget, with 0.5% of the state budget allocated to lawmaking activities, and is eligible to receive legitimate support from domestic organizations and individuals.
Regarding policies related to ensuring and improving the quality of human resources, the draft Resolution has two basic contents.
Specifically, regarding ensuring support for personnel involved in lawmaking, the draft Resolution stipulates a monthly support allowance equal to 100% of the current salary based on the salary coefficient (excluding allowances) for those participating in lawmaking. This allowance is developed based on the principle of timely institutionalization, targeting the right beneficiaries, and focusing on key areas in accordance with the spirit of Resolution 66-NQ/TW, recognizing clearly defined target groups, and ensuring greater consistency and consensus among agencies during the research and drafting process.
Regarding ensuring and improving the quality of human resources working in lawmaking and law enforcement, the draft Resolution specifies solutions for the State to have special policies and mechanisms to attract high-quality human resources for lawmaking and law enforcement, ranging from specialized training, priority recruitment, attraction, and preferential treatment of high-quality human resources; mechanisms for planning and seconding officials; to applying a mechanism for autonomy in choosing cooperation methods or hiring experts and consulting organizations in lawmaking and law enforcement.
Regarding policies for developing and applying digital technology and digital transformation to serve the innovation and modernization of lawmaking and law enforcement, the draft Resolution stipulates mechanisms and policies for building a large database on law; applying artificial intelligence and developing virtual assistants for lawmaking and law enforcement based on exploiting large legal databases; developing information technology infrastructure, information systems, and digital platforms to serve the management, drafting, and promulgation of legal documents and a number of tasks and activities in law enforcement that directly support lawmaking.

We highly appreciate the efforts, urgency, seriousness, and responsibility of the Government.
Reviewing this draft Resolution, the Chairman of the National Assembly's Committee on Law and Justice, Hoang Thanh Tung, stated that the Committee on Law and Justice (UBPLTP) and other National Assembly agencies agree on the necessity of issuing the Resolution based on the political, legal, and practical grounds as outlined in the Government's submission; at the same time, they highly appreciate the efforts, urgency, seriousness, and responsibility of the Government and the drafting agency in preparing the project dossier; they agree with submitting the project according to the simplified procedure; and the project dossier is complete and in accordance with regulations.
The Standing Committee of the National Assembly's Law Committee recognizes that the draft Resolution has thoroughly grasped and closely followed the Party's guidelines and directions, especially in promptly implementing the specific requirements of the Politburo in Resolution No. 66/NQ-TW on reforming the work of lawmaking and enforcement to meet the requirements of national development in the new era. Therefore, the Standing Committee of the National Assembly's Law Committee basically agrees with the scope of the Resolution; at the same time, it agrees with the Government's proposed direction for drafting the Resolution, which includes both general, overarching, and principled provisions, as well as some specific provisions that can be implemented immediately after the Resolution is adopted, thus quickly bringing the Party's new guidelines and policies in Resolution No. 66-NQ/TW and related resolutions into practice.
Regarding the special financial mechanisms and policies for lawmaking, the Committee on Legal Affairs and other agencies agree with the provisions of the draft Resolution on the state budget ensuring that expenditure on lawmaking is not less than 0.5% of the total annual state budget expenditure and gradually increases according to development requirements, ensuring the level and limits of expenditure linked to the allocation of funds for lawmaking and the establishment of a Fund to support the development of policies and laws. This is because these major policies all stem from practical requirements and have been clearly defined in Resolution No. 66-NQ/TW, meeting the requirements set out in Resolution 27-NQ/TW.
Regarding the allocation of funds in the legislative process, many opinions within the Legal Affairs Committee suggested that the current regulations should be retained to ensure consistency in implementation principles and to facilitate the management, inspection, and evaluation of the effectiveness of fund utilization.
Regarding policies to ensure the attraction, remuneration, and improvement of human resource quality, the Committee on Legal Affairs basically agrees with the regulation on monthly support for those directly and regularly engaged in strategic planning, policy research, and lawmaking as stipulated in Clause 1, Article 7 of the draft Resolution, in order to institutionalize the requirements of Resolution No. 66-NQ/TW and Conclusion No. 119-KL/TW.
At the same time, recognizing that the monthly support policy is not simply about increasing income, creating motivation, and encouraging dedication, but also about clearly defining responsibility, integrity, and the high demands of the Party, State, and People on this team of officials and civil servants in performing their duties, it is a breakthrough solution to improve the quality of legal human resources, aiming towards professionalization and long-term stability of this workforce.
