Quang Nam Provincial Inspectorate requests recovery of 1.57 billion VND due to planning violations

According to the inspection conclusion, in the period of 2015 - 2022, the planning and implementation of construction planning in the province basically ensured compliance with functions, tasks, and authorities, in accordance with legal regulations...

However, planning and implementation in some units and localities still have limitations such as: planning organization, especially zoning planning, is slow and prolonged; the preparation of boundary marker records in the field for submission to competent authorities for appraisal, approval and implementation is slow, and some places have not yet organized planning marker placement.

In addition, some planning projects are slow to be implemented; the budget for planning costs has not been recovered due to transferring the project investor's role to businesses in the form of business...
Regarding the management of budget funds for planning, the Quang Nam Provincial Inspectorate found that the Tam Quang Residential Area Project (Nui Thanh District, scale of 107.5 hectares) had violations.

Specifically, the project was organized by the Compensation and Site Clearance Center under the Chu Lai Open Economic Zone Management Board (now the Provincial Economic Zones and Industrial Zones Management Board) to establish a 1/500 detailed construction plan in 2014; the detailed plan was approved by the Chu Lai Open Economic Zone Management Board in 2015.

After that, the project was recognized by the Provincial People's Committee as an investor and agreed on the project investment policy for 3 enterprises. For this project, the state budget has arranged and settled the cost of preparing the detailed planning (1/500) with the amount of more than 1.81 billion VND. According to regulations, funds from the state budget do not belong to construction investment projects in the form of business.

Accordingly, the Inspectorate of Quang Nam province determined that the 3 enterprises that are the investors of this project are responsible for repaying the budget for the cost of establishing the detailed planning of Tam Quang residential area with an amount of more than 787 million VND (on an area of ​​more than 46.5 hectares).

Particularly for the Dien An Ward Central Residential Area Project (scale of 14.8 hectares), the People's Committee of Quang Nam province assigned the People's Committee of Dien Ban town to organize the preparation of detailed planning.

According to the approved construction planning, the project is divided into two areas. After that, the project was recognized by the Provincial People's Committee as the investor and approved the investment policy for two enterprises to invest in the construction of the project in the form of business, including Minh Hoang Long Construction Joint Stock Company and An Phu Urban Investment and Development Joint Stock Company.

The Provincial Inspectorate requested the People's Committee of Dien Ban town to be responsible for refunding the amount of money for detailed planning of the above project, which is 791 million VND, the amount that has been arranged and settled for the cost of preparing detailed planning (1/500) of the above project (currently recovered and deposited into the temporary account of the Quang Nam Provincial Inspectorate).
