Implementing the program of the 5th Session, on the morning of June 10, the National Assembly discussed in groups the draft Law on Citizen Identification (amended). The National Assembly delegation of Binh Thuan province participated in the discussion in group 14.
Giving opinions on the draft Law on Citizen Identification (amended), delegates affirmed that the Law on Citizen Identification 2014 marked an important step forward in the legislative work. However, in addition to positive results, in the process of implementing the Law on Citizen Identification 2014, there have been some shortcomings and arising issues that need to be considered for amendment and supplementation.
Delegates basically agreed with the necessity of promulgating the Law on Identification to institutionalize the Party's guidelines and policies and the State's policies on promoting the application of information technology, proactively participating in the Fourth Industrial Revolution, building e- Government , handling administrative procedures and providing online public services; creating a legal basis for implementation, creating a breakthrough in digital transformation in all fields.
Commenting specifically on point L, clause 1, article 19 on the content shown on the ID card, Deputy Head of the Provincial National Assembly Delegation Nguyen Huu Thong said that the content about "place of residence" often changes, in reality there are many shortcomings. The delegates agreed that the place of residence must be included in the ID card for management by the authorities, but it needs to be shown appropriately. Therefore, the delegates suggested that the phrase "place of residence" should be changed to "place of permanent residence" to be consistent with the provisions of Article 11 of the Law on Residence.
Regarding the deadline for issuing, exchanging and reissuing ID cards in Article 27, the draft stipulates a deadline of 7 working days. Delegate Nguyen Huu Thong said that this is too long in the context of promoting digitalization and the Government's implementation of the development of data applications on population, identification and electronic authentication to serve national digital transformation in the period of 2022-2025, with a vision to 2030 (Project 06). Therefore, the delegate suggested considering and only stipulating 7 days for cases where the information is unclear, and for cases where the information is clear, it should be stipulated to issue within the day to facilitate citizens' transactions.
Regarding the cases of issuing, exchanging and re-issuing citizen identification cards in Article 25, the delegate proposed to add the phrase "updating biometrics" to point b, clause 1. At the same time, it was proposed to consider having a provision regulating the issuance and exchange of citizen identification cards for adults who have undergone cosmetic surgery on the face...
Commenting on the proposed name change of the draft law from “Law on Citizen Identification” to “Law on Identification”, National Assembly Deputy Tran Hong Nguyen said that it is necessary to consider because according to the provisions of the current law, the scope of regulation is all Vietnamese citizens. Up to this point, ID cards have been issued to about 80 million people. The reason for changing the name to Law on Identification is that the Government has found that there are currently more than 31,000 cases where ID cards are not issued but only certificates are issued. According to the delegate, these cases are not common so there can still be regulations to adjust them as exceptional cases. Therefore, the delegate of the Drafting Committee considers whether such a change is appropriate or not.
Regarding the regulation on granting citizen identification cards to people under 14 years old, delegates expressed concerns because these cases rarely participate in civil transactions and transactions that require the use of cards; when making transactions, there is already a guardian so it is not necessary to use an identification card...
