In addition, regulations on partial sick leave are added to ensure the best benefits for employees. Specifically, the half-day sick leave benefit will be calculated as half of the one-day sick leave benefit. When calculating the sick leave benefit for employees who are absent from work and are entitled to partial sick leave, absences of less than half a day will be counted as half a day; from half a day to less than one day will be counted as one day.

The 2024 Social Insurance Law also amends the regulations on long-term sick leave. Accordingly, employees can enjoy sick leave for a maximum of 30 to 70 days per year, depending on working conditions, with a benefit level equal to 75% of the salary used as the basis for social insurance contributions. After the benefit period expires and treatment continues, employees who take leave due to illness on the list of illnesses requiring long-term treatment issued by the Minister of Health will continue to enjoy sick leave at a lower benefit level.
Regarding maternity benefits, the 2024 Social Insurance Law supplements regulations on conditions for enjoying maternity benefits for female employees who give birth and have to take time off work to treat infertility before giving birth. Accordingly, female employees only need to pay compulsory social insurance for at least 6 months in the 24 consecutive months before taking maternity leave. In case a female employee is pregnant for at least 22 weeks but has a miscarriage, abortion, or stillbirth, or stillbirth during labor, the female employee and her husband will be entitled to take maternity leave as in the case of a female employee giving birth. Employees will also have their health insurance paid by the Social Insurance Fund during their leave if they enjoy maternity benefits for 14 working days or more in a month.
The 2024 Social Insurance Law stipulates that from July 1, 2025, employees who voluntarily participate in social insurance when giving birth, if meeting the conditions, will receive a subsidy of 2 million VND for each child born and each fetus from 22 weeks old or older that dies in the womb or dies during labor. Along with that, the right to receive sick leave and maternity benefits for non-professional workers at the commune level will be added, instead of only receiving 2 retirement and death benefits as in the 2014 Social Insurance Law.
Deputy Director of the Provincial Social Insurance Trinh Quang Nghia said that the 2024 Social Insurance Law has added many new points that are beneficial to participants. The Provincial Social Insurance is coordinating with associations, unions, and local authorities to disseminate new points of the 2024 Social Insurance Law, including sickness and maternity benefits to employees. Thereby, helping employees understand correctly and fully the policies and regimes according to the provisions of the 2024 Social Insurance Law.
