Piloting special mechanisms and policies for urban railway development

The purpose of issuing the Plan is to institutionalize and fully implement the viewpoints, goals, tasks and solutions set out in Resolution No. 188/2025/QH15 of the National Assembly .

At the same time, clearly define the tasks for ministries, branches and localities to carry out related work to prepare for investment, invest in urban railway lines, develop urban areas in the direction of TOD, develop industry, train railway human resources; as a basis for the Government, the Prime Minister and ministries, branches and localities to focus on directing and organizing implementation, ensuring compliance with legal regulations, progress, quality, strict management and economical, effective, public and transparent use of capital, preventing corruption, waste and negativity.

The urban railway projects in the two cities are large-scale, require high and modern technology and techniques, and are being implemented very urgently; the National Assembly has allowed the application of many specific and special mechanisms and policies for implementation. In order for the implementation of the Project to meet the required quality and progress, in addition to regular tasks, ministries, ministerial-level agencies, and provincial People's Committees organize the implementation of the following 3 tasks:

Drafting and promulgating legal documents

Regarding the development and promulgation of legal documents, the Resolution requires:

Legal documents (Clause 4, Article 4 and Clause 1, Point a, Point b, Clause 2, Clause 3, Clause 4, Article 5 of Resolution No. 188/2025/QH15 of the National Assembly) stipulate the content and requirements for survey, establishment of overall technical design (FEED design) to replace the basic design in the project Feasibility Study Report and design steps implemented after FEED design, establishment and management of construction investment costs of projects applying FEED design...: implemented according to Decree No. 123/2025/ND-CP dated June 11, 2025 of the Government detailing the overall technical design and specific mechanisms for a number of railway projects.

Legal documents (Clause 2, Point a, Clause 3, Article 7 of Resolution No. 188/2025/QH15 of the National Assembly) stipulate the development of science, technology and training and development of human resources for urban railway projects; stipulate criteria for selecting state-owned organizations and enterprises assigned tasks or Vietnamese organizations and enterprises ordered to provide railway industrial services and goods: implemented according to Resolution No. 106/NQ-CP dated April 23, 2025 of the Government on the implementation plan of the North-South high-speed railway project.

Develop and promulgate the Prime Minister's Decision (Point b, Clause 3, Article 7, Resolution No. 188/2025/QH15 of the National Assembly) regulating the list of railway industrial services and goods assigned to state-owned organizations and enterprises or ordered to Vietnamese organizations and enterprises: implemented according to Resolution No. 106/NQ-CP dated April 23, 2025 of the Government on the plan to implement the high-speed railway project on the North-South axis.

Regarding the development and promulgation of Resolutions of the People's Council (Clause 1, Article 6, Clause 1, Article 9 of Resolution No. 188/2025/QH15 of the National Assembly) on urban development according to the TOD model and detailed regulations on methods for determining collection levels, authority, order and procedures for collecting fees for developing urban railway systems, public transport systems, technical infrastructure connecting with public passenger transport systems: The People's Councils of Hanoi and Ho Chi Minh City detail specific policies in Clause 1, Article 6 and Clause 1, Article 9 of Resolution No. 188/2025/QH15 of the National Assembly according to their authority and legal regulations.

Implement Resolution No. 188/2025/QH15 to ensure publicity, transparency, efficiency, and prevent policy profiteering, loss, and waste.

Regarding the implementation of specific tasks of Resolution No. 188/2025/QH15, Hanoi City and Ho Chi Minh City are the competent authorities, coordinating with relevant ministries, branches and localities to organize the implementation of this Resolution to ensure publicity, transparency, efficiency, feasibility and progress, avoiding policy exploitation, loss and waste; directing departments, branches and localities to organize the implementation to ensure consistency, unity and efficiency.

The Human Resources Development Project and the Railway Industry Development Project are implemented according to the specific tasks of local ministries and branches in Resolution No. 127/NQ-CP dated May 13, 2025 of the Government.

Urban development oriented towards public transport development (TOD)

The Resolution requests Hanoi and Ho Chi Minh City to preside over and coordinate with ministries and branches to perform the following tasks:

- Review and adjust the planning of the surrounding areas of railway stations and depots, adjust planning, architecture, technical infrastructure, and social infrastructure indicators (if necessary) to implement land exploitation projects according to the TOD model.

- Organize the establishment and approval of land exploitation projects according to the TOD model at urban railway stations and depots.

- Arrange local budget capital to implement public investment projects to carry out compensation, support and resettlement work according to the planning of the area surrounding the railway station to create land for auction for urban development according to the provisions of law.

- Organize auctions of land funds in the vicinity of railway stations and depots for urban development according to the law to create a budget source for the locality.

This Resolution takes effect from the date of signing (October 9, 2025).
