Piloting specific and special mechanisms and policies to develop the urban railway network system

The Government has just issued a Plan to implement Resolution No. 188/2025/QH15 dated February 19, 2025 of the National Assembly to pilot a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City.

The plan states: Pursuant to the Resolution on piloting a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City, approved by the 15th National Assembly in Resolution No. 188/2025/QH15 dated February 19, 2025 (hereinafter referred to as Resolution No. 188/2025/QH15), the Government issued a Plan to implement Resolution No. 188/2025/QH15.

The purpose of the Plan is to organize the institutionalization and full implementation of the viewpoints, goals, tasks and solutions set out in Resolution No. 188/2025/QH15 of the National Assembly ; Clearly define the tasks for ministries, branches and localities to carry out related work to prepare for investment, invest in urban railway lines, develop industry, train railway human resources; serve as a basis for the Government, the Prime Minister and ministries, branches and localities to focus on directing and organizing implementation, ensuring compliance with legal regulations, progress, quality, strict management and economical, effective, public, transparent use of capital, preventing corruption, waste and negativity.

At the same time, it is required to closely follow the policy approved by the National Assembly to organize, implement and manage investment in the urban railway network system in the two cities in accordance with the Resolution of the National Assembly; manage and use capital and resources economically and effectively, prevent and combat corruption, and avoid taking advantage of policies, loss and waste.

Specify policies and solutions approved by the National Assembly through legal documents guiding their implementation to have a full legal corridor, facilitate the implementation process, mobilize resources to carry out urban railway projects, and ensure compliance with international treaties of which Vietnam is a member.

Clearly define the authority, responsibility, and progress of work implementation of ministries, branches, and localities in the process of implementing tasks and work to meet the progress requirements of the Party, the National Assembly, and the Government. Urban railway projects in the two cities are large-scale, require high-tech and modern techniques, and have a very urgent implementation progress; the National Assembly has allowed the application of many specific and special mechanisms and policies for implementation.

In order for the implementation of the Project to meet the required quality and progress, in addition to regular tasks, the Government assigns ministries, ministerial-level agencies, and provincial People's Committees to develop and promulgate the Government's Decree: Legal documents (Clause 4, Article 4 and Clause 1, Point a, Point b, Clause 2, Clause 3, Clause 4, Article 5 of Resolution No. 188/2025/QH15 of the National Assembly) regulating the content and requirements for survey, establishment of overall technical design (FEED design) to replace the basic design in the Project Feasibility Study Report and design steps implemented after FEED design, establishment and management of construction investment costs of projects applying FEED design...: implemented according to Decree No. 123/2025/ND-CP dated June 11, 2025 of the Government detailing the overall technical design and specific mechanisms for a number of projects. railway project

Legal documents (Clause 2, Point a, Clause 3, Article 7 of Resolution No. 188/2025/QH15 of the National Assembly) stipulate the development of science and technology and training and development of human resources for urban railway projects; stipulate criteria for selecting organizations and state-owned enterprises assigned tasks or Vietnamese organizations and enterprises ordered to provide railway industrial services and goods: implemented according to Resolution No. 106/NQ-CP dated April 23, 2025 of the Government on the plan to implement the high-speed railway project on the North-South axis.

Develop and promulgate the Prime Minister's Decision (Point b, Clause 3, Article 7, Resolution No. 188/2025/QH15 of the National Assembly) regulating the list of railway industrial services and goods assigned to state-owned organizations and enterprises or ordered to Vietnamese organizations and enterprises: implemented in accordance with Resolution No. 106/NQ-CP dated April 23, 2025 of the Government on the plan to implement the high-speed railway project on the North-South axis.

Develop and promulgate Resolutions of the People's Council (Clause 1, Article 6, Clause 1, Article 9 of Resolution No. 188/2025/QH15 of the National Assembly) on urban development according to the urban development model associated with public transport (TOD) and specify in detail the method of determining collection levels, authority, order and procedures for collecting fees for developing urban railway systems, public transport systems, technical infrastructure connecting with public passenger transport systems: The People's Councils of Hanoi and Ho Chi Minh City specify in detail the specific policies in Clause 1, Article 6 and Clause 1, Article 9 of Resolution No. 188/2025/QH15 of the National Assembly according to their authority and legal provisions.

Hanoi and Ho Chi Minh City are the governing bodies, coordinating with relevant ministries, branches and localities to organize the implementation of this Resolution to ensure publicity, transparency, efficiency, feasibility and progress, avoiding policy exploitation, loss and waste; directing departments, branches and localities to organize the implementation to ensure consistency, unity and efficiency. The specific tasks of the two cities, ministries, branches and localities and the time to complete related tasks are carried out according to the Appendix of the Resolution.

The Human Resources Development Project and the Railway Industry Development Project are implemented according to the specific tasks of local ministries and branches in Resolution No. 127/NQ-CP dated May 13, 2025 of the Government.

Hanoi and Ho Chi Minh City shall preside over and coordinate with ministries and branches to carry out the following tasks: Review and adjust the planning of the area surrounding railway stations and depots, adjust the planning, architecture, technical infrastructure and social infrastructure indicators (if necessary) to implement land fund exploitation projects according to the urban development model associated with public transport; Organize the establishment and approval of land fund exploitation projects according to the TOD model at urban railway stations and depots; Arrange local budget sources to implement public investment projects to carry out compensation, support and resettlement work according to the planning of the area surrounding railway stations to create land funds for auction for urban development according to the provisions of law; Organize the auction of land funds in the area surrounding railway stations and depots for urban development according to the provisions of law to create budget sources for localities.

Based on the content of Resolution No. 188/2025/QH15 of the National Assembly, the implementation plan of the Government, ministries, ministerial-level agencies, Government agencies, People's Committees of provinces and centrally run cities, according to their functions and tasks, organize the implementation of assigned tasks to meet the required progress.

Ministers, Heads of ministerial-level agencies, Government agencies, Chairmen of the People's Committees of Hanoi and Ho Chi Minh City focus on directing the implementation of assigned tasks; strengthen inspection and supervision of the implementation of plans for urban railway projects in the two cities, periodically report quarterly and annually on implementation results to the Ministry of Construction for synthesis and reporting to the Government and the Steering Committee for key and important national railway projects to have necessary measures and solutions to ensure the synchronous and effective implementation of projects.

During the implementation process, in case it is necessary to amend or supplement the implementation plan or specific and special mechanisms and policies... ministries, branches and localities shall proactively propose to send to the Ministry of Construction for synthesis and reporting to the Government and the Prime Minister for consideration and decision according to their authority or for the Government to report to the National Assembly and the National Assembly Standing Committee for consideration and decision./.
