In law-making, Prime Minister Pham Minh Chinh requested to resolutely abandon the mindset of "if you can't manage, ban; if you don't know, manage." Instead, whoever manages best should be assigned the task. This guiding spirit was emphasized by Prime Minister Pham Minh Chinh, Head of the Steering Committee for reviewing and organizing the implementation of handling problems in the legal system, when concluding the 4th meeting of the Steering Committee on the afternoon of December 29. The meeting focused on discussing and giving opinions on handling problems and shortcomings related to decentralization, delegation of power, and authorization; reviewing legal documents affected by organizational and apparatus arrangements. According to the Ministry of Justice , to date, there are more than 5,000 documents directly affected by the reorganization of the apparatus, of which more than 2,800 documents are related to changes in the names of agencies, organizations and units; nearly 1,900 documents have content that needs to be handled immediately and more than 300 documents have content that needs to be handled but is not urgent. Meanwhile, the Ministry of Home Affairs said that the laws on decentralization, delegation of power and authorization are mainly stipulated in the draft Law on Government Organization (amended); the draft Law on Organization of Local Government (amended) and a number of specialized laws. Through review, there are more than 1,000 legal documents containing content related to the above two Laws. Emphasizing a number of guiding viewpoints, the Prime Minister requested to resolutely abandon the mindset of "if you can't manage, ban, if you don't know, manage". Instead, he thoroughly implemented the mindset of "whoever manages best should be given the task", "people and businesses can do what the law does not prohibit", "what is prohibited should be put into the law, what is not prohibited should be created space for creativity", "what businesses and people can do and do better, the State definitely will not do". According to the Prime Minister, State management only focuses on building strategies, planning, laws, mechanisms, policies, creating development; promoting decentralization and delegation of power along with appropriate resource allocation, improving enforcement capacity, designing tools to strengthen inspection, supervision, and control of power. The Government leader emphasized that the work should not be "taken" to the Central Government, but localities should decide, localities should do, and localities should be responsible. Regarding a number of specific and key tasks in the coming time, the Prime Minister requested ministries and branches to review, research, develop, amend and supplement legal documents affected by the restructuring of the apparatus; promptly submit and issue documents serving the restructuring of the apparatus to ensure streamlining, strength, efficiency, effectiveness and efficiency; not leaving legal gaps and interruptions in operations. The Prime Minister requested the Ministry of Justice to preside over and develop a Resolution for submission to the National Assembly on handling problems and issues arising from the restructuring of the apparatus, in which it proposed to stipulate principles and assigned the Government to continue providing specific instructions. The Ministry of Home Affairs presides over and develops a Resolution for submission to the National Assembly on the establishment of a number of ministries of the 15th Government for the 2021-2026 term after receiving the Party's policy. The Prime Minister also directed the Ministry of Home Affairs to develop a draft Law on Government Organization (amended) and a draft Law on Organization of Local Government (amended); The Ministry of Justice is drafting the Law on Promulgation of Legal Documents (amended). The Ministry of Finance is assigned to complete the draft Law on Management and Investment of State Capital in Enterprises; urgently submit it to the Government in January 2025 for consideration and approval by the National Assembly according to the shortened procedure. According to the head of the Government, in addition to the laws and resolutions to be submitted to the National Assembly at the 9th extraordinary session, the Law and Ordinance Development Program for 2025 is also very heavy, so agencies need to proactively and urgently coordinate to ensure progress and quality.
