The timely drafting of the Law on Artificial Intelligence is extremely important, contributing to creating a legal foundation to promote research, development, application and management of artificial intelligence in a safe, responsible and humane manner.

On the afternoon of October 15, the National Assembly's Committee on Science, Technology and Environment coordinated with the Ministry of Science and Technology and the Vietnam Federation of Commerce and Industry to organize a workshop on "Giving comments to perfect the draft Law on Artificial Intelligence".

Laying the legal foundation for the entire artificial intelligence ecosystem

According to Dr. Tran Van Khai, Vice Chairman of the National Assembly's Committee on Science, Technology and Environment: Artificial intelligence is a breakthrough technology platform of the Fourth Industrial Revolution, which is deeply impacting all areas of life, from production, business, education, healthcare, transportation, to defense and security. In Vietnam, artificial intelligence is identified as one of the national priority technologies, playing a key role in digital transformation, developing a knowledge-based economy and enhancing national competitiveness.

Resolution No. 57-NQ/TW on breakthroughs in science, technology, innovation and national digital transformation has set the goal of Vietnam being among the top three countries in Southeast Asia in research and development of artificial intelligence; gradually mastering a number of strategic technologies and digital technologies such as artificial intelligence; strongly developing the application of artificial intelligence based on big data in important industries and fields.

However, the rapid development of artificial intelligence also poses many legal, ethical, responsibility and safety challenges, requiring an appropriate legal corridor that both strictly manages and encourages and promotes development and innovation.

Therefore, the timely drafting of the Law on Artificial Intelligence to submit to the National Assembly for consideration and promulgation is extremely important.

“This is Vietnam's first law in this field, contributing to creating a legal foundation to promote research, development, application and management of AI in a safe, responsible and humane manner,” Mr. Khai stated.

Clarify insurance mechanisms, liability limits and risk allocation criteria - ensuring rationality and feasibility

Mr. Dau Anh Tuan, Deputy Secretary General and Head of the Legal Department of the Vietnam Federation of Commerce and Industry, commented that the National Assembly and the Government's initiative in developing the Law on Artificial Intelligence is a timely step, demonstrating the mindset of institutional creation, catching up with technological trends and opening up the space for innovation. This is the first law in Vietnam to lay the legal foundation for the entire artificial intelligence ecosystem - from development, application, to risk management and protection of people's rights.

Emphasizing from the business perspective, the Vietnam Federation of Commerce and Industry highly appreciated the spirit of openness, science and innovation in the draft Law. Mr. Tuan said that many key contents have been approached according to international standards such as: risk-based management, controlled testing mechanism (sandbox), ethics and human rights in artificial intelligence, or regulations on transparency, accountability and labeling of content generated by artificial intelligence.

However, in order for the Law to truly come into life and become a driving force for development, Mr. Tuan also noted a number of major points: It is necessary to ensure flexibility and adaptability in the legal framework; minimize administrative barriers for businesses, especially small businesses and startups. At the same time, it is necessary to seriously invest in data and computing infrastructure - this is the vital "fuel" of artificial intelligence; clearly define legal responsibilities, especially in the artificial intelligence value chain - from developers, suppliers to deployers.

“The Law's proposal of objective legal responsibility for high-risk systems is appropriate, but it is necessary to clarify the insurance mechanism, liability limits and criteria for allocating risks in a reasonable and enforceable manner,” said Mr. Tuan.

Articles 11 and 15 of the draft Law stipulate that high-risk artificial intelligence systems must self-classify and initially assess their suitability before being put on the market or when there are significant changes during operation.

According to lawyer Nguyen Tuan Linh - BMVN International Law Firm, the self-assessment/classification requirement for high-risk AI systems is too broad and may require AI development platform suppliers or importers to classify all AI systems that users create through the platforms - which is technically infeasible for suppliers or importers and also inconsistent with the practices of the AI ​​industry.

“Putting this responsibility on platform owners could also have unintended consequences. It could discourage them from providing open or flexible development environments, especially for startups, researchers and enterprises,” the lawyer said.

From the above analysis, lawyer Tuan Linh recommends that there should be a clear exemption - suppliers or importers of artificial intelligence development platforms are exempted from self-classifying high-risk artificial intelligences created by their users.

Regarding the pre-tax mechanism for artificial intelligence systems, Mr. Tran Van Tri, Director of Vietnam Law Media Joint Stock Company, suggested that it should be considered more flexibly so as not to slow down the progress of launching artificial intelligence products, especially in the context of rapidly changing technology. At the same time, there should be more specific and clear regulations on the scope and level of application of labeled intelligence.
