Implement new regulations on decentralization and delegation of authority in the field of ethnic, belief and religious affairs from July 1

(GLO)- On June 11, the Government issued Decree 124/2025/ND-CP regulating decentralization and delegation; defining the authority of two-level local authorities in the field of ethnic affairs, beliefs and religions.

Accordingly, Decree 124/2025/ND-CP specifically stipulates the decentralization of state management in the field of ethnic affairs, beliefs and religions.

The approval of the list of communes in regions III, II, I and recognition of extremely disadvantaged villages in ethnic minority and mountainous areas for the period 2021-2025 is stipulated in Clause 4, Article 7 of Decision No. 33/2020/QD-TTg dated November 12, 2020 of the Prime Minister on criteria for delimiting ethnic minority and mountainous areas according to development level for the period 2021-2025 under the authority of the Provincial People's Committee.

The Decree also specifies the responsibilities of People's Committees at all levels in approving the list of communes in regions III, II, I and recognizing extremely disadvantaged villages in ethnic minority and mountainous areas for the period 2021-2025: For the Provincial People's Committee, based on the criteria specified in Decision No. 33/2020/QD-TTg, direct the Commune People's Committee to organize the review and make a list of communes in regions III, II, I and extremely disadvantaged villages in ethnic minority and mountainous areas for the period 2021-2025 to send to the Provincial People's Committee for consideration and approval.

For the People's Committee at the commune level, it is responsible for, based on the criteria specified in Decision No. 33/2020/QD-TTg, to organize the review and prepare a dossier to determine the list of communes in regions III, II, I and extremely disadvantaged villages in ethnic minority and mountainous areas for the period 2021-2025 and send it to the People's Committee at the provincial level according to regulations.

Provide and be responsible for the accuracy of relevant documents and data during the inspection and review process to determine communes in regions III, II, I and extremely disadvantaged villages in ethnic minority and mountainous areas in the period 2021-2025.

The recognition, removal from the list and replacement and addition of prestigious people among ethnic minorities (hereinafter referred to as prestigious people) as prescribed in Point e, Clause 1 and Point d, Clause 3, Article 6 of Decision No. 12/2018/QD-TTg dated March 6, 2018 of the Prime Minister on criteria for selection, recognition of prestigious people and policies for prestigious people among ethnic minorities (amended and supplemented in Clause 8, Article 1 of Decision No. 28/2023/QD-TTg dated November 23, 2023 of the Prime Minister) are under the authority of the Chairman of the People's Committee of the commune, ward, and special zone (hereinafter referred to as the People's Committee at the commune level).

According to the Decree, the decision on the number of prestigious people in the case of a newly established village due to the merger of villages as prescribed in Point b, Clause 3, Article 4 of Decision No. 12/2018/QD-TTg, amended and supplemented in Decision No. 28/2023/QD-TTg, is under the authority of the Chairman of the People's Committee at the commune level.

The authority to receive the notification of organizing a periodic religious festival as prescribed in Clause 1, Article 13 of the Law on Belief and Religion is assigned: The People's Committee of the commune where the festival is organized is responsible for receiving the notification document of the representative and the management board of the religious establishment for a religious festival organized in a commune.

The People's Committee of the province where the festival is held is responsible for receiving written notices from representatives and management boards of religious establishments for religious festivals held in many communes of the province.

Decree 124/2025/ND-CP takes effect from July 1, 2025. This Decree expires from March 1, 2027, except in cases where a competent authority decides to extend the application period of all or part of this Decree.
