Ho Chi Minh City directs to prevent fraudulent behavior through buying and selling land and apartments

Specifically, in recent times, the prosecution agencies have initiated, investigated, prosecuted, and tried many criminal cases of fraud and appropriation of property related to the subdivision and sale of land and the purchase and sale of apartments. Despite the complete legal provisions, criminals have taken advantage of the need for housing and the lack of knowledge of the people to commit fraudulent acts, using many sophisticated tricks.

The subjects transferred land plots and apartments that did not meet the transfer conditions to appropriate large sums of money, causing great damage to people's property, losing people's trust in state agencies, and affecting local security and order.

Faced with this situation, the People's Procuracy has recommended that the Chairman of the Ho Chi Minh City People's Committee direct the Department of Natural Resources and Environment and the People's Committees of districts, towns, and Thu Duc City to thoroughly instruct all departments and offices to proactively grasp the situation of land and apartment sales in the area. From there, check and compare the conditions for buying, selling, and transferring the project to promptly detect and inform the competent authorities to prevent and not let subjects scam people.

At the same time, soon complete the database system of information on land and assets in the management area, to support and share information in the field of state management, ensure and provide accuracy of project information, information on apartment systems eligible for transactions in the area.

The People's Procuracy also recommended directing the Department of Construction to publicly announce housing that is eligible for sale or lease-purchase so that consumers know before participating in transactions related to the purchase and sale of apartments.

At the same time, it is recommended that the City People's Committee direct the Department of Justice and the People's Committees of districts, towns, and Thu Duc City to strengthen the propaganda, dissemination, and legaleducation to improve people's knowledge of land and housing laws, avoiding fraud. At the same time, review the current land use status of households, individuals, and organizations in the area to coordinate with competent agencies in land statistics and inventories according to regulations.

From there, strict management helps detect, prevent and promptly handle illegal transfers of land use rights and illegal changes of land use purposes; detect, apply measures to prevent and promptly handle construction of works on encroached land, occupied land, land used for the wrong purpose in the locality and force violators to restore the land to its original condition before the violation.

Taking note of these recommendations, the leaders of the Ho Chi Minh City People's Committee assigned the Department of Natural Resources and Environment, the Department of Construction, the Department of Justice, the People's Committees of districts and Thu Duc City to study and organize the implementation of the above solutions, and report the results to the City People's Committee.
