Accordingly, overtime pay is paid to teachers who have completed the teaching load as prescribed by the Ministry of Education and Training and who participate in teaching the second session as officially assigned by the school. The funding for this payment is allocated from the state budget and other socialized sources as regulated.

Specifically, the average teaching load per week, used as the basis for calculating standard teaching hours, is as follows: Primary school teachers: 23 lessons/week; Secondary school teachers: 19 lessons/week; High school teachers: 17 lessons/week. Any teaching hours exceeding the standard load when teaching two sessions per day will be counted as extra teaching hours.
The determination and payment of overtime pay are based on the timetable, teaching assignment schedule, and related evidence, and are approved by the head of the unit. The school is responsible for arranging a reasonable timetable, ensuring adequate staffing and facilities, and implementing fair assignments among teachers.
Regarding payment methods, overtime pay is calculated according to Circular No. 21/2025 of the Ministry of Education and Training. Accordingly, each teaching hour exceeding the standard rate is paid at 150% of the salary for a standard teaching hour; the maximum number of overtime hours for which payment is made is no more than 200 hours per academic year. In exceptional cases due to teacher shortages or exceeding the prescribed number of hours, educational institutions must report to their governing body for consideration and handling within their authority.
The Ho Chi Minh City Department of Education and Training also emphasized that overtime teaching must be based on the voluntary consent of teachers, ensuring the legitimate rights of the teaching staff.
Regarding funding, for afternoon teaching activities funded by the state budget, the funds for overtime pay are allocated in the annual budget estimates of public non-profit organizations according to current regulations. However, in 2025, as this is a new issue arising from the Prime Minister's directive, units will be considered for supplementary budget allocations if the payment exceeds the allocated budget.
For afternoon teaching activities conducted through a socialized model, educational institutions may use revenue from services supporting educational activities to pay teachers' salaries based on mutual agreement.
Educational institutions may make payments or advances for overtime pay on a monthly, semester, or annual basis, depending on actual conditions and in agreement with teachers. From the second semester of the 2025-2026 school year, this expenditure will be included in the budget estimates at the beginning of the year.
The Ho Chi Minh City Department of Education and Training requires that overtime pay be paid in accordance with regulations, openly and transparently, thereby ensuring the rights of teachers and contributing to improving the quality of two-session-per-day teaching in the city.
