Specifically, electronic notarized documents are created directly in the electronic environment according to the direct or online electronic notarization process prescribed in the Notarization Law, this Decree and legal regulations on electronic transactions.
Notarized paper documents converted into electronic documents according to the provisions of the Public Law and the law on electronic transactions, with the digital signature of the notary and the digital signature of the notary practice organization are also considered electronic public documents.
Electronic notarized documents must have a QR-Code or link or code or other unique form of symbol to perform reference and verify authenticity.
The digital signature of transaction participants, witnesses, and interpreters on electronic notarized documents is performed in the presence of a notary, except in cases where the authorized person has registered a sample signature as prescribed in Clause 2, Article 50 of the Law on Notarization.
Page numbering of electronic notarized documents is carried out according to the provisions of Clause 1, Article 51 of the Law on Notarization.
The correction of technical errors in an electronic notarized document shall be made into a document page containing the technical error correction, with the digital signature of the notary and the notary practice organization. The technical error correction document must be attached to the electronic notarized document and must appear with the electronic notarized document when referenced.
The amendment, supplement, termination, and cancellation of electronically notarized transactions shall be carried out in accordance with the provisions of Clause 1, Article 53 of the Law on Notarization. The document amending, supplementing, terminating, or canceling the transaction must be attached to the electronically notarized document and must appear with the electronically notarized document when referenced.
Scope of transactions applicable to electronic notarization
Direct electronic notarization is applied to all civil transactions.
Online electronic notarization is applied to civil transactions, except for wills and other unilateral legal civil transactions.
Diplomatic representative agencies shall perform electronic notarization for transactions as prescribed in Clause 1, Article 73 of the Law on Notarization.
