The retirement age is being adjusted to increase gradually according to the roadmap. Therefore, to solve the retirement regime for civil servants, it is necessary to determine the retirement age of workers in 2025.
Determine retirement age: full age, early age and over age
The retirement age of civil servants is implemented according to the provisions of the 2019 Labor Code.
Specifically, according to Clause 1, Article 60 of the 2008 Law on Cadres and Civil Servants, civil servants are entitled to retire according to the provisions of the Labor Code.
According to Article 169 of the 2019 Labor Code, the retirement age is stipulated as follows:
Employees who ensure the conditions on social insurance payment period according to the provisions of the law on social insurance are entitled to receive pension when reaching retirement age.
The retirement age of employees in normal working conditions is adjusted according to the roadmap until reaching 62 years old for male employees in 2028 and 60 years old for female employees in 2035.
From 2021, the retirement age of employees in normal working conditions is 60 years and 3 months for male employees and 55 years and 4 months for female employees. After that, it will increase by 3 months for male employees and 4 months for female employees each year.
Employees with reduced working capacity; working in particularly arduous, toxic, or dangerous occupations or jobs; working in areas with particularly difficult socio -economic conditions may retire at a lower age, but not more than 5 years older than the age prescribed in Clause 2 of this Article at the time of retirement, except in cases where the law provides otherwise.
Employees with high professional and technical qualifications and some special cases may retire at a higher age but not more than 5 years older than the age specified in Clause 2 of this Article at the time of retirement, except where otherwise provided by law.
Thus, the retirement age of civil servants in 2025 under normal working conditions for male workers is 61 years and 3 months, and for female workers is 56 years and 8 months.
For workers with reduced working capacity; working in especially arduous, toxic, or dangerous jobs; working in arduous, toxic, or dangerous jobs... the lowest retirement age for male workers is 56 years and 3 months, and for female workers is 51 years and 8 months.
For workers with high technical expertise and some special cases, the highest retirement age for male workers is not more than 66 years and 3 months, and for female workers is not more than 61 years and 8 months.
What is the policy for civil servants to retire early?
Streamlining the apparatus in the spirit of Resolution 18 of the Central Committee, it is expected that many people will be able to retire before the prescribed age.
The Ministry of Justice has just announced a draft Decree stipulating the regime and policies for officials who are not old enough to be re-elected or re-appointed to positions and titles according to their terms of office in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations. This draft was drafted by the Ministry of Home Affairs.
To implement the policy, the Ministry of Home Affairs proposes that officials who are not re-elected or re-appointed and have paid compulsory social insurance for 20 years or more, if they voluntarily apply for early retirement and are approved by competent authorities, will be entitled to pension benefits according to the law on social insurance.
The above-mentioned cadres are also entitled to an additional allowance of 5 months of current salary at the time of early retirement for each year of early retirement.
In addition, cadres who retire early are also entitled to a number of other benefits such as: No deduction of pension rate; 5 months of salary subsidy for the first 20 years of work, with social insurance contributions; from the 21st year onwards, for each year of work with social insurance contributions, 1/2 month of salary subsidy is granted...
Mr. Bui Sy Loi, former Vice Chairman of the National Assembly's Committee on Social Affairs, said that for those with less than 5 years of work left, there should be a policy to resolve and encourage early retirement with the spirit of "retiring early to make room for those who stay".
For these people, the government should issue a flexible retirement policy such as not having to deduct the pension rate, or maybe deducting less, or even supporting a sum of money as the long-standing policy has done to ensure their lives when they stop working for the government.
In particular, for those who retire early but are still able to work, the state also needs to have support policies so that they can work and contribute to society.
