Need to unify the evaluation system for civil servants and public employees

Concerned about the mechanisms and policies in the draft Law on Civil Servants (amended) on attracting and retaining talented people, National Assembly Delegate Doan Thi Le An ( Cao Bang ) pointed out that currently many public service units are losing high-quality human resources to the private sector. Especially after the Covid-19 pandemic, the shift of high-quality human resources to the private sector is quite large.

Therefore, the delegates suggested that the drafting committee study and supplement regulations on salary policies, working environment benefits and promotion opportunities in accordance with the characteristics of the industry and the results of their contributions. It is necessary to encourage the mechanism of contract work, contract expenditure and expert contracts.

Minister of Construction Tran Hong Minh, National Assembly Delegate of Cao Bang Province, said that civil servants and public employees have similar dedication and efforts, but the regulations, mechanisms, and legal policies for these two groups are different. To move towards equality in the dedication of civil servants and public employees, the Minister said that it is necessary to study and unify the regime and policies for civil servants stipulated in the Law on Civil Servants and for public employees stipulated in the Law on Public Employees.

The Draft Law has provisions to innovate the recruitment of civil servants in the direction of clearly defining the form of work performance of professional civil servants, equality and the form of reception for high-quality human resources.

“Professors, associate professors or doctors, despite their great contributions to the country’s science , are still civil servants. To work in a state management agency, they must take an exam and comply with many other binding conditions.”

However, Minister Tran Hong Minh noted that in reality, ministries and branches must abide by many binding terms when they want to recruit professors, associate professors, and doctors who have made many contributions to science at universities to work at specialized agencies in their ministries and branches.

Given the above reality, the Minister suggested that the draft Law on Civil Servants (amended) should continue to be improved to remove these binding regulations, creating conditions for management agencies to recruit and use high-quality human resources.

In reality, the Minister of Construction also noted that the salary fund and welfare regimes in public service units located in big cities are very good, but in remote mountainous areas they can only be enough to pay the minimum wage.

The difference in salary and bonus is also easily seen in universities located in Ho Chi Minh City and Hanoi, and in other provinces and cities, causing lecturers to feel uncertain.

“On average, teachers at Ho Chi Minh City University of Transport earn up to 70 million VND/month because the school does a good job of recruiting students. But even at a university like the Aviation Academy - a very important academy for our country's aviation industry - the average salary of lecturers is only about 20 million VND,” said the Minister.

Therefore, the Minister of Construction suggested that there should be mechanisms and policies to support public service units in mountainous and remote areas; and supplement regulations regulating salary funds between units to avoid creating too large a difference even though the nature of the work is the same, requiring the same dedication. Along with that, there should be a common scale for evaluating civil servants and public employees, avoiding making overly strict regulations.

National Assembly Deputies Nguyen Van Quang (Da Nang) and Le Van Dung (Da Nang) suggested that there should be a priority mechanism in the appointment planning for officials with achievements or seniority working in difficult areas as a form of incentive to retain officials. This principle can be incorporated into the development of regulations guiding the use of assessment results to plan appointments and assign to higher positions for those who have completed their tasks excellently.

Delegate Nguyen Van Quang pointed out that in reality, current decrees on recruiting doctors and medical staff to grassroots hospitals set out strict conditions. In addition to graduating with honors, there are also conditions on international articles, participation in research projects, etc.

"This makes it very difficult for remote areas to recruit doctors, and many grassroots hospitals do not have doctors to work for this reason."

Therefore, delegates suggested having more flexible regulations for recruiting civil servants in public service units in remote and isolated areas; having a mechanism for selection and special selection. Applying the principle of "limited selection" in an equal manner will be difficult for public service units in this area.

Clearly specify the time for conversion from a fixed-term to an indefinite-term contract

Regarding the employment contract regime, delegate Doan Thi Le An suggested that the draft Law should clarify the boundary between fixed-term contracts and indefinite-term contracts. At the same time, it should ensure the rights and psychological stability of civil servants, especially in specific public service sectors such as education and health.

Delegates also said that it is necessary to consider a periodic evaluation mechanism based on work results instead of automatically terminating the contract after each stage.

Regarding the classification of civil servants, delegates proposed more specific regulations on criteria, scales and assessment methods linked to output results and task completion levels, avoiding the situation of equalization. There should also be an independent monitoring mechanism and public disclosure of assessment results to ensure fairness and transparency.

Also interested in this content, National Assembly Deputy Nguyen Viet Ha (Tuyen Quang) noticed that some contents of the draft Law on Public Employees (amended) are being applied according to labor law (such as regulations on termination of employment, retirement), but there are some other contents such as signing labor contracts, handling violations... with separate regulations applied to public employees. However, these provisions in the draft Law are still general, while adjusting very specific contents, directly related to the rights of public employees.

Therefore, delegate Nguyen Viet Ha suggested that it is necessary to study, supplement and perfect the regulations on the contents of labor contracts and the handling of termination of employment. In particular, it is necessary to clearly stipulate how much time must be spent on converting from a fixed-term contract to an indefinite-term contract, and the procedures for handling violations must be very specific to facilitate implementation.

To ensure ethnic policies in the draft Law on Civil Servants (amended), National Assembly Delegate Trang A Duong (Tuyen Quang) proposed that in the provisions of Clause 5, Article 3, it is necessary to add special priority policies in the development and recruitment of civil servants who are ethnic minorities and civil servants with good professional qualifications to work in ethnic minority areas, mountainous areas, islands, and borders.

Similarly, with the provisions in Clause 7, Article 9 on the obligations of management officials, it is necessary to add the obligation to pay attention to implementing specific policies for officials who are ethnic minorities when building and developing human resources.

Delegate Trang A Duong also suggested that the drafting agency should study and supplement regulations clearly specifying the priority mechanism in recruiting civil servants from ethnic minorities; with detailed and easily changeable contents, the Government can issue detailed guidance documents.
