At the question and answer session, the eighth session of the People's Council of Thua Thien Hue province, term VIII, 2021-2026, delegate Duong Thi Thu Truyen questioned the results of the implementation of Resolution 02/2022/NQ-HDND dated January 25, 2022 of the People's Council of Thua Thien Hue province on Regulations on a number of policies to support the relocation of industrial and handicraft establishments into industrial clusters in Thua Thien Hue province by 2025.

Regarding this issue, in response to the question, Mr. Nguyen Thanh - Director of the Department of Industry and Trade of Thua Thien Hue said that, implementing Resolution 02, the People's Committee of Thua Thien Hue province has issued documents directing departments, branches and localities to implement; announced administrative procedures, approved internal procedures for handling administrative procedures to ensure effective implementation of relocation support policies; issued Plan No. 321/KH-UBND dated August 30, 2022 on supporting the relocation of industrial and handicraft establishments to industrial clusters in Thua Thien Hue province by 2025.
In order to have production space to serve the relocation of industrial and handicraft establishments into industrial clusters, the Provincial People's Committee has issued a Plan on investment in developing technical infrastructure of industrial clusters in Thua Thien Hue province for the period of 2021-2025; approved the addition of industrial clusters: Dien Loc 2, Phu Dien, Thuy Phuong to the Master Plan of Thua Thien Hue province while the Provincial Plan has not been approved; Decision No. 89/QD-UBND dated January 9, 2023 on approving the adjustment of the development plan of industrial clusters in Thua Thien Hue province for the period of 2021-2030, and approved the establishment of industrial clusters Binh Thanh (scale of 32 hectares), Dien Loc 2 (scale of 20.82 hectares), adjusted the establishment of Dien Loc industrial cluster (scale of 27.6 hectares) from non-budgetary investment capital.
According to the Director of the Department of Industry and Trade of Thua Thien Hue, however, currently, because industrial clusters are implementing investment in technical infrastructure construction, there is no land to arrange production facilities in the industrial clusters. For industrial clusters that have been established and put into operation, the district-level Project Management Board for Investment and Construction is the investor, because they have not properly performed the function of investing in and trading in technical infrastructure of industrial clusters, while according to the provisions of the 2013 Land Law, Decree No. 148/2020/ND-CP dated December 18, 2020 of the Government amending and supplementing a number of decrees detailing the implementation of the Land Law, there are no regulations for production facilities in industrial clusters to directly lease land from the State. Therefore, the implementation of the relocation policy has not been guaranteed according to the requirements and progress set out because there is no land to arrange for production facilities to relocate to the industrial clusters.
The Director of the Department of Industry and Trade of Thua Thien Hue explained that the Land Law 2024 (effective from August 1, 2024) stipulates: "In case an industrial cluster is established before the effective date of this Law and is invested in infrastructure construction by a public service unit, district-level People's Committee, or commune-level People's Committee, the authority to lease land to organizations, households, and individuals investing in production and business in the industrial cluster shall comply with the provisions of Article 123 of this Law."
Therefore, for industrial clusters invested by the District-level Project Management Board for Construction Investment before the effective date of the 2024 Land Law (including industrial clusters: Thuy Phuong, Tu Ha, Huong Hoa, Vinh Hung), production and business projects invested in these industrial clusters will be leased land by the State to implement investment projects according to the provisions of Article 123 of the 2024 Land Law.
Director of the Department of Industry and Trade of Thua Thien Hue Nguyen Thanh suggested: To effectively implement Resolution No. 02, districts, towns, and Hue City need to guide production establishments to develop relocation plans, implement relocation into industrial clusters, and build support funds in 2025 according to regulations; continue to pay attention to allocating the budget for investment in building technical infrastructure for industrial clusters, focusing on investing in environmental protection infrastructure in industrial clusters to ensure compliance with the provisions of the Law on Environmental Protection 2020.
In particular, urgently build a centralized wastewater collection and treatment system to ensure that treated wastewater meets environmental protection requirements to have sufficient conditions to serve the relocation of production facilities to industrial clusters. Speed up the site clearance of industrial clusters (Binh Thanh, Dien Loc, Dien Loc 2); pay attention to and support the resolution of difficulties and obstacles so that these projects can soon come into operation."
