Administrative violations in fire prevention, fire fighting, rescue and relief are subject to fines of up to 100 million VND.

The Government issued Decree 106/2025/ND-CP regulating administrative sanctions for violations in the fields of fire prevention, fire fighting, rescue and relief.

Decree 106/2025/ND-CP stipulates a fine of VND 6 million to VND 8 million for acts of not issuing or not posting regulations, signs, prohibition signs, and signs on fire prevention, fire fighting, rescue, and relief.

Fines from 8 million VND to 10 million VND for the act of not arranging forces and means of the Fire Prevention, Fire Fighting and Rescue Team, and the specialized Fire Prevention, Fire Fighting and Rescue Team to be on duty for fire fighting and rescue on a daily basis.

In particular, the Decree stipulates a fine of VND 10 million to VND 20 million for the act of not establishing a fire prevention, firefighting and rescue team at the facility; a fine of VND 20 million to VND 30 million for the act of not establishing a specialized fire prevention, firefighting and rescue team.

The Decree also specifically stipulates the fines for violations of fire prevention and fighting regulations in the use of fire sources, heat sources, fire-generating and heat-generating equipment and tools.

Specifically, a fine of 5 million to 10 million VND applies to the act of using fire sources, heat sources, fire-generating or heat-generating equipment and tools without ensuring fire prevention and fighting distance according to regulations.

Fines from 20 million VND to 25 million VND for one of the following acts: Using fire sources, heat sources, fire-generating or heat-generating equipment and tools in prohibited areas; welding or cutting metal without fire prevention and fighting measures as prescribed.

The Decree stipulates a fine of twice the fine for the above-mentioned acts when causing a fire but not to the extent of criminal prosecution.

No fire prevention solution for electric vehicle charging area will be fined up to 50 million VND

The Decree stipulates a fine of 10 million to 15 million VND for the act of not maintaining equipped and installed explosion-proof electrical equipment.

For the act of not equipping, installing, or using explosion-proof electrical equipment, the fine is from 20 million to 25 million VND.

Fines from 40 million VND to 50 million VND for one of the following acts: No fire prevention solution for the charging area for electric motor vehicles concentrated indoors; no electrical system for fire prevention and fighting; no maintenance of power source for fire prevention and fighting.

Failure to equip or install a fire alarm and fire fighting system will result in a fine of up to 50 million VND.

For violations of regulations on equipment and installation of fire prevention, fire fighting, rescue and relief equipment, the Decree stipulates a fine of 5 million to 7 million VND for the act of equipping and installing lights, emergency lighting equipment, and escape instructions that do not comply with regulations.

Fines from 8 million VND to 10 million VND for the act of equipping fire prevention, fire fighting, rescue and salvage equipment for the Fire Prevention, Fire Fighting and Rescue Team at the facility and the specialized Fire Prevention, Fire Fighting and Rescue Team that does not meet the regulations.

Fine from 10 million to 15 million VND for not equipping or installing lights, emergency lighting equipment, or escape instructions.

For the act of not equipping the Fire Prevention, Fire Fighting, Rescue and First Aid Team with fire prevention, fire fighting and first aid equipment, the fine will be from 15 million to 20 million VND.

Fine from 20 million VND to 25 million VND for the act of not equipping fire prevention, fire fighting, rescue and salvage equipment for the specialized fire prevention, fire fighting and rescue team.

For one of the following acts: Equipping and installing equipment in a fire alarm system that does not comply with regulations; equipping and installing equipment in a fire fighting system that does not comply with regulations shall be fined from 30 million VND to 40 million VND.

Fines from 40 million VND to 50 million VND for one of the following acts: Not equipping or installing a fire alarm system; not equipping or installing a fire fighting system; not equipping fire fighting, rescue and mechanical rescue equipment.

The above penalty is applied to an administrative violation of an individual.

Households, business households, and residential communities that violate the provisions of this Decree shall be subject to administrative fines applied to individuals.
